violation of these terms may subject the permittee to a fine or criminal or civil action;and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that I)prior to undertaking any activities authorized by this permit,the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s).

FOR PIER AND DOCKING FACILITIES ACCESS WAY
A riparian buffer authorization is required for pier and docking facilities access ways through the Tar-Pamlico &
Neuse River Riparian buffer per Division of Water Resources (DWR) regulations 15A NCAC 026.0233 &.0259. The
Division of Coastal Management (DCM), through a Memorandum of Understanding with the Division of Water
Resources (DWR) has reviewed your project proposal and has determined that the project as proposed complies
with the aforementioned regulations.
Those activities covered by your Coastal Area Management Act(CAMA) permit have received Buffer Authorization
provided the project is constructed in a manner that continues to meet all of the conditions listed below. Failure to
comply with this Buffer Authorization may subject the property owner and the party (contractor) performing the
construction and/or•land clearing to a civil penalty by DWR of up to $25,000 per day per violation.
i. Crossing is Perpendicular: Pier and docking facility access way must cross the 50 ft. riparian buffer
perpendicularly(which is defined as between 75 and 105 degrees) unless otherwise approved by DCM. The
alignment shall minimize the removal of woody vegetation to the greatest extent practicable.
2. Pervious Materials:All reasonable measures shall be taken to ensure the access way is made of pervious
materials like open-slatted wood or composite, mulch, or grass to meet the intent of the rules to the
maximum extent practicable.
3. Access Width: The width of the pier or docking facility access way shall be limited to six (6) feet.
4. Project Drawing:The drawing on the CAMA General Permit is considered the project.drawing of your
property indicating the relative location of the pier or docking facility and any requested access way. This
drawing will be used to aid in compliance and monitoring efforts.

THIS EASEMENT("Easement"),made and entered into as of the date set forth in the
notary acknowledgment below, by and between the STATE OF NORTH CAROLINA, a body
politic and corporate,hereinafter referred to as GRANTOR, and TIDELAND ELECTRIC
MEMBERSHIP CORPORATION,a North Carolina limited liability company,hereinafter
referred to as GRANTEE;
WITNESSETH:
THAT,WHEREAS, the North Carolina Department of Administration,has authorized
and approved the execution of this instrument for the purposes herein expressed; and,
WHEREAS,the execution of this instrument for and on behalf of the State of North
Carolina has been duly approved by the Council of State by resolution adopted at a meeting held
in the City of Raleigh,North Carolina, on the 6th day of October,2020; and,
WHEREAS,the Grantor owns that certain parcel or tract of land situated in Long Acre
Township,Beaufort County,North Carolina as more particularly described as(the"Property").
NOW,THEREFORE,in consideration of the sum of TWO HUNDRED FIFTY
DOLLARS and NO/100 DOLLARS($250.00),and other good and valuable consideration,the
receipt of which is hereby acknowledged,the Grantor does hereby grant unto Grantee,its
successors and assigns,the right,privilege and easement to construct, operate and maintain an
aerial electrical line together with accessories and appurtenances necessary in connection
therewith(sometimes referred to herein as the"facilities"),for the purposes and subject to the
terms and conditions set forth herein,upon,over and across the Property,within the easement

area being more particularly described as follows:
1. A utility easement of+/-40,860 sq. ft. (0.94) acre,more or less which is
more particularly described on Exhibit A, attached.
IT IS UNDERSTOOD AND AGREED BETWEEN GRANTOR AND GRANTEE:
1. This Easement is granted subject to all existing rights of way and easements
within the easement area.
2. Grantor reserves the right to utilize the area within the easement area for all
purposes not inconsistent with the easement rights herein conveyed.
3. The facilities erected hereunder shall remain the property of Grantee. Grantee
shall have the right to inspect,rebuild,remove,repair,improve,relocate on the areas above
described, and make such changes,alterations, substitutions,additions to or extensions of its
facilities as Grantee may from time to time deem advisable.
4. For the purpose of inspecting,rebuilding,removing,maintaining,improving,
repairing or relocating its facilities,Grantee shall have the right of ingress to and egress from the
easement area over the lands of Grantor adjacent to the easement area and lying between public
or private roads and the easement area in such manner as shall occasion the least practicable
damage and inconvenience to Grantor.
5. Grantee shall repair damage to roads,fences or other improvements and shall pay
Grantor for other damage done in the process of the relocation or maintenance of Grantee's
facilities, or in the exercise of its right of ingress and egress.
6. If said aerial electrical line is not operated at the location described above for a
continuous period of twelve(12)months,this Easement shall be deemed abandoned.
7. It is further understood and agreed that this conveyance is made subject to the
condition that Grantee shall properly obtain all necessary permits required by State and federal
law. Failure to obtain such permits in a timely manner shall be deemed an abandonment of this
Easement.
TO HAVE AND TO HOLD the aforesaid rights,privileges and easements unto said
Grantee,its successors and assigns,for so long as Grantee maintains said aerial electrical line and
no longer.
IN TESTIMONY WHEREOF,the STATE OF NORTH CAROLINA has caused this
instrument to be executed in its name by ROY COOPER,Governor,attested by ELAINE F.
MARSHALL,Secretary of State, and the Great Seal of the State of North Carolina to be hereto
affixed by virtue of the power and authority aforesaid.
