This matter was heard on oral arguments and stipulated facts at the regularly scheduled
meeting of the North Carolina Coastal Resources Commission (hereinafter CRC) on September 24,
1998, in Morehead City, North Carolina pursuant to N.C.G.S. § 113A-120.1 and T15A NCAC
7J.0700, et seq. Associate Attorney General Mary Penny Thompson appeared for the Department
of Environment and Natural Resources, Division of Coastal Management; Petitioners John and
Barbara Kelley chose not to appear. '
Upon consideration of the record documents and the arguments of the parties, the CRC
adopts the following:
STIPULATED FACTS
1. Petitioners' property is located at 107 Trout Avenue, Topsail Beach, North Carolina
in Pender County. The lot fronts a man-made canal approximately one and a half miles from New
Topsail Inlet. It is not located on an ocean-facing shoreline and does not contain oceanside
characteristics such as dunes or wetland vegetation.
?. Both an Estuarine Waters Area of Environmental Concern (AEC) and an Ocean
Hazard AEC overlap Petitioner's lot.
3. Petitioners sought a CAMA General Permit to replace existing canal decking and
ramps with an uncovered boat lift, a finger pier and a floating dock.
4. The proposed development consists of a boat lift not exceeding 400 square feet and
extending no more than 13 feet onto Petitioners' property; a 4-foot by 20-foot stationary finger pier;
a 3-foot by 12-foot finger pier (from the stationary finger pier to the floating dock); and a 10-foot by
12-foot floating dock.
5. The adjacent neighbors have no objections to the project.
6. The Division of Coastal Management denied Petitioners' General Permit request on
August 17, 1998 due to its inconsistency with Rule 15A NCAC 7H.1200 which allows piers and
docks in an Estuarine Waters AEC, but prohibits them in an Ocean Hazard AEC.
7. Piers and floating docks are common structures along man-made canals in estuarine
waters.
Based on the foregoing, Stipulated Facts, the Commission makes the following:
CONCLUSIONS OF LAW
1. The CRC has jurisdiction over the parties and the subject matter.
2. The parties have been correctly designated and there is no question of misjoinder or
nonjoinder of parties.
3. All notices for the proceeding were adequate and proper.
4. Application of 15A NCAC 7H.1201 to deny Petitioners a general permit for construction
of a pier and floating dock on his property will result in practical difficulties or unnecessary
hardship to Petitioners in that Petitioners will be unable to have water access.
5. The hardship is caused by conditions peculiar to Petitioners' property which is within both
the Estuarine Shoreline and Ocean Hazard Area of Environmental Concern, but has characteristics
of an estuarine rather than an ocean shoreline.
6. The Commission could not reasonably have anticipated, at the time of adoption, that the

general permit for construction of piers, docks and boat houses, T15A NCAC .1200, would not be
available to certain property owners on estuarine shorelines because of expansion of the ocean
hazard AEC to include the estuarine shoreline in some areas.
7. The proposed development is within the spirit, purpose and intent of the Commission's
rules in that the rules allow construction of piers, docks and boat houses on estuarine shorelines and
Petitioner's property has the characteristics of an estuarine shoreline.
THEREFORE, the petition for variance from T15A NCAC 7H.1201 is GRANTED and a
CAMA general permit shall be issued for installation of a pier, floating dock and boatlift waterward
of Petitioners' property consistent with the standards otherwise set out in the referenced general
permit rules.
