Dear Mr. Whitaker:
On September 10, 1998, a bulkhead permit was issued to Sylvia Herring authorizing
the construction of a 62' long bulkhead on her lot at 602 Evelyn Lane in Topsail Beach.
I established the bulkhead alignment landward of all coastal wetlands and drove stakes
to visually establish the line. Enclosed is a copy of that CAMA General Permit for your
review. Also attached is a copy of Section T15A:07H.1100, the rules dealing with
bulkhead construction. Please note that the 15' setback is not required for bulkhead
construction (only piers/docks/lifts/pilings).
Mrs. Herring's request met all of the conditions for a General Permit. Therefore, as an
agent of the State, I was obliged to issue the permit over your objections. However,
you do have the right of appeal. You may request to appeal my permit decision to the
Chairman of the Coastal Resources Commission. Enclosed are the forms you will need
for that action. The appeal must be filed within twenty (20) days of receiving this letter.

number is 919 716-6957 should you wish to discuss the appeal process. Thank you for
