Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) ,
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

WE, the adjacent property owners have objections to the proposed boat -lift
at 188 Elliott Rd. DCM-EC
There is concern about the proposed boat lift because it's in a very
questionable location and his drawings seem ridiculously inaccurate.
Mr. Moody is proposing to put a boat lift on the north -side attached to his pier.
The existing structure appears to be much closer (maybe only 15') in actuality
than this drawing revels.
This shows 35' from our corner post & bulkhead and
represents a 50' pier in length, according to the drawing.
Doing the Math, he has only allowed 15' to leave and retrieve his approx. 15' boat, pushing the break-
water/ wake and boat dangerously close to our property and his as well.
To maneuver a motor boat in this area would easily encroach our waterway and put a wake into our
bulkhead, steps, pier and dock. It's questionable, especially when other options are apparent!
This north -side location is a squeeze and infringes into our water -way.
It appears his boat may need to even travel into our water line to leave and retrieve.
Also, taking into considering the prevailing northeast winds and driven waves that already push water
onto his lower land, we question Mr. Moody's thinking.
Again this appears to be the worst location for a boat lift.
Furthermore, it shows a carelessness disregard to our property, our breakwater, our children and
recreational water area and Safety is an issue. We are 5 year residence at this location and have
experienced in 5 years, unauthorized trespassing, suspected sabotage and passive aggressive bulling
behavior from this neighbor and his family, however, we continue to respect the boundaries of our
property lines and enjoy the area.
Although his power source is located in the north -side of his pier, it can easily be moved the 48 inches
to the south.
The drawing we received, appears to be out of proportion to any accurate measurements.
We humbly object to this location and ask for a full review of the plans before a permit is rewarded,
taking into consideration Our property, family and investment Matters!
