On behalf of Duane Seward of Sewre LLC, I would like to request a CAMA General Permit for maintenance
of the existing fixed pier and gazebo, and replacement of floating docks and boat lifts at 135 Dogwood
Lane (PIN 3281-95-6894-0000) in Hampstead, Pender County. The applicant proposes maintenance of
the fixed pier and 20' x 20' covered gazebo. The application also proposes replacement of (2) 4' x 26'
floating finger docks, an 8' x 20' floating dock, (5) 12' x 12' boat lifts, and a 3' x 16' access ramp in the
original footprint as permitted in April 2006 through CAMA Major Permit number 58-06. There is no
additional upland work proposed on the property. Figures, Signed Agent Authorization, Deed, Previous
Permit, Plat Map, Riparian Notifications/Waivers, and $200 application fee check are enclosed.

Docking Facility
1) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure. f

2) This permit authorizes only the docks, piers, and other structures and uses located in or over the

water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures shall be conducted on, in or over public
trust waters without permit modification. •

ADDITIONAL CONDITIONS
•
The pier additions and associated structures shall have a minimum setback distance of 15 feet between
any parts of the structure and the adjacent property owner's riparian access corridor. This corridor is
determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel
line that intersects with the shore at the point where the upland property line meets the water's edge.
No portion of the permitted structure shall be located within 80 feet of the near bottom edge of the
federally maintained.AIWW channel. ;_
) No portion of the permitted docking facility shall extend more than 1/4 the width of the waterbody, which t ,
is measured from the waterward edge of the coastal wetlands on either side of the AIWW.
In order to ensure compliance with Condition Nos. 3, 4, and 5 of this permit, an as-built survey that
depicts the COE setback, the adjacent riparian corridors, and the authorized pier, shall be performed on ••
the docking facility, and copies of the survey shall be provided to the U.S. Army Corp. of Engineers and
the Division of Coastal Management, within 60 days of completion of construction.
OTE: Failure to provide the survey referenced in Condition No. 6 may result in a violation of this
permit.
Any portion of the permitted access pier and docking facilities built over coastal wetlands shall not
•exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and
shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are
permitted. Lattice is specifically excluded from being used under this authorization.
The roof of the gazebo shall not be designed for second story use.

\OTE: The permittee is cautioned that this permit does not authorize the placement of tie piles in
association with the docking facility. Further more, due to the proximity of the AIWW, boats
utilizing the docking facility will be subject to frequent wavewash from passing vessels. The
issuance of this permit does not relieve the permittee from taking all proper steps to ensure the
integrity of the structure and the safety of moored boats. The permittee shall not hold the State
of North Carolina or the United States liable for any damage to the structure or moored boats.

15) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from-the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
16) The West Indian Manatee (Trichecus munatus), which is listed as a federally endangered species, has
been reported in North Carolina waters. In order to protect the West Indian manatee all work should be
done during the period from November 1 to May 31. •If work must be done during the period from June
through October the enclosed guidelines, entitled "Precautions for General Construction in Areas Which
may Be Used by the West Indian Manatee in North Carolina" shall be followed.
17) No vegetated wetlands shall be excavated or filled, even temporarily.
18) No open water areas shall be excavated, including excavation resulting from "kicking" with boat
propellers

approvals or authorizations that may be required.
