Dear Mr. Morgan:
This letter confirms that I was at 2802 Sea Vista Road SW in the Supply Township
of Brunswick County on March 11, 1999 to investigate the possibility of development in
an Area of Environmental Concern without proper authorization. My visit revealed that
a pier with a stationary and second story deck has been constructed. Records show that
a permit had been obtained for the construction of a pier, boatlift and decks. However, the
permit expired on September 9, 1999, which was prior to the construction work.
Furthermore, a rule change which went into effect on August 1, 1998 prohibits second
story decks and reduces the limits of square footage for "T"s, finger piers, platforms and
decks. Your lot, which has a waterward boundary width of 50 feet is limited to a total of
200 square feet of "T"s, finger piers, platforms and decks. Your development exceeds
the limit by approximately 192 square feet which does not include the second story deck.
Therefore, you are in violation and restorative action will be required.
I request that you immediately CEASE AND DESIST any further development and
contact me about this matter. Since some of development you have undertaken is not
consistent with the applicable standards, you will be required to restore the area to an
acceptable condition. A civil assessment of up to $2500.00 may be assessed against any
violator. Each day that the development described in this Notice is continued or repeated
may constitute a separate violation which is subject to an additional assessment of
$2500.00. An injunction or criminal penalty may also be sought to enforce any violation.

It is the policy of the Coastal Resources Commission to assess a minimum civil
penalty of One Hundred Fifty Dollars ($150.00) against all violations. This is done to
recoup some of the costs of investigating the violation and/or to compensate the public
for any damage to its natural resources. Whether a higher amount will be assessed, will
depend on several factors, including the nature and area of the resources which were
affected and the extent of the damage to them. If restoration of the affected resources is
requested but is not undertaken or completed satisfactorily, a substantially higher civil
penalty will be assessed and a court injunction will be sought ordering restoration.
The enclosed Restoration Plan describes the action necessary to bring this project into
compliance with the Act. Provided you intend to comply with the directives of the plan as
requested, please sign one of the attached Restoration Plans and return it to me in the
enclosed, self-addressed envelope. No response from you within ten (10) days of receipt
of this letter will be interpreted as a refusal to cooperate and result in a continuing
violation and a court order will be sought ordering restoration.
The relevant statutes and regulations are available from this office, and I am willing to
assist you in complying with the requirements of these laws. A site inspection will be
made in the immediate future to determine if compliance of this REQUEST TO CEASE
AND DESIST has been met. Again, I urge you to contact me immediately about this
matter.
