Maxwell Jr (property owners), hereby consents, agrees and authorizes the entry upon our property for the purposes of dredging activities associated with Scarboro Creek and waters adjacent to the Peninsula Subdivision to be performed by Peninsula Subdivision Homeowners Association. The property that I own that is affected by these activities is located in the County of Dare and identified by Parcel No. 025797004. 'Flie Peninsula Subdivision Homeowners Association, and all others performing work associated with the dredging of these waters agree to indemnify and hold harmless the property owner(s) from any and all claims, suits, losses and/or damages of any kind, inclusive of legal fees and court costs arising, directly or indirectly, from any action filed or brought by any third party including the State of North Carolina arising firorn the entry upon property owner's property, and activities associated with the dredging of these waters. The Peninsula Subdivision Homeowners Association is solely responsible for rectifying any nuisances resulting from the dredging project.
