Re: Objection to the Issuance of CAMA General Permit No.79234A for
a Development Project at 4009 and 4004 W. Soundside Road in
Nags Head, Dare County
Dear Ms. Trotman and Mr. Maramenides:
This correspondence is in response to your objection as an adjacent riparian properly
owner to a permit request from Mark and Karen Johnson for the docking facility
proposed at 4009 and 4004 W. Soundside Road in Nags Head, Dare County. Yvonne
Carver, of the Division of Coastal Management field staff, and I were recently on site to
evaluate the permit applicants' request.
The permit applicants have requested a permit to construct a pier with finger piers,
covered and uncovered platform, and boatlift. Under the Coastal Area Management Act
(CAMA), the Coastal Resources Commission (CRC) has established Rules for General
Permits for this type of development that are found in 15A NCAC 07H.1200 (a copy of
which was provided to you on July 1, 2021 via email).
You have notified the Division of Coastal Management of your objections to this
proposed development by a formal letter, which was received by our office on July 7,
2021. Your objections to this proposed development related to potential erosion and
property damage during storms, impacts to local vegetation and osprey nesting, water
depth, and public access. The Division has reviewed your objections, along with all
aspects of this development proposal for consistency with the aforementioned Rules,
which describe the CRC's standards and guidelines for this type of development. Our
review of the application and the project site has found the proposal to be consistent
with these Rules.

After having given careful consideration to your objections to this proposed
development, we have determined that it is consistent with the Rules of the CRC and
the State's Coastal Management Program, and that all pre -requisites have been
satisfied. Therefore, the Division of Coastal Management issued General Permit No.
79234 on July 20, 2021 (copy enclosed).
If you wish to appeal this permit decision, you must file a Third Party Hearing Request
Form with the Director of the Division of Coastal Management within 20 days of the
permit issuance date. If you choose to pursue an appeal, please contact this office so
that we can provide you with the appropriate forms and addresses.
If you have any further questions regarding this matter, please do not hesitate to contact

We have been requested by the above property owners to do the following work'
1. Construct a 4' x 100' pier with a 12x12' covered hip roof and a 4x12 sun deck.
2. 4' x 44.5 walkway around right side of pier.
3. 1- 10K Boatlift with 4-8"x25' poles..
In order for us to obtain the Cama permit for this project, Cama (Coastal Area Management) requires
each adjacent property owner to be notified. We would ask that you sign the attached form and return to
us as soon as you can. You may scan and email, fax or simply mail. We are also attaching a sketch of the

I formally object to the proposed work by Karen and Mark Johnson at 4009 W Soundside Rd.
The sandy beach area where they are proposing their structure has for years had an erosion
issue. We unfortunately have dealt with this on almost a yearly basis. We've paid for boulders,
bulkheads, and planting to stabilize the area. Photos are attached to show the area where it
over washes when they are storms. I am concerned the proposed structure and activity that
ensues, will aid in the erosion process and we'll have even more issues in the future.
Additionally, the area houses vegetation that supports a myriad of wildlife and migratory
nesting birds.
The depth of the water where they want to put the boat lift and pier is very shallow and should
be investigated to see if it can be used as intended. Making sure public access is maintained
should also be a consideration.
The proposed work is overly large, with a boat lift, sun deck and roof. It is directly adjacent to
our master bedroom, master bathroom and screened in dining porch and we will no longer be
able to enjoy the privacy that we currently have.
We are concerned about the possibility of property damage from the proposed structure to our
house and property. The possibility of a hurricane or bad storm blowing the boat and structure
onto our property and causing significant property damage, should not be ignored.
Finally, is an annual nesting osprey couple that return every year, to raise their young at the
proposed site and I don't want to discourage the protected migratory actions of these osprey.
