Dear Mr. Gregson:
This is the second submission for a permit at the aforementioned location, and I
have enclosed the information from the first.
Not included in the package sent to us by Land Management Group was a Division
of Coastal Management Adjacent Riparian Property Owner Notification Form.
However, under the Waiver Section of the form, the paragraph reads:
"I understand that a pier, dock, mooring pilings, breakwater, boat house, lift or
sandbags must be sent back a minimum distance of 15' from my area of riparian
access unless waived by me."
1. The "existing dolphins" as shown on the plan are not offset 15' as required in
the Waiver Section. As I am sure your records will show, we did not receive or
sign any waiver acquiescing to the installation of the "existing dolphins". These
dolphins should be removed or brought into compliance with the 15' setback
requirement of the Waiver Section.

2. As described on the plan, the "new dolphins" will be offset 15' from the south.
As there are no corresponding dolphins to the north, we are very concerned that
the dockage space occupied by the vessel will exceed the allowable 20' building
width. The vessel, moored there more or less permanently, effectively becomes
a "movable dock," thus violating the spirit, if not the letter, of the regulations,
which are fundamentally designed to assure homeowners safety and unfettered
access to their property.
For the above reasons, we do object to the proposed boat slip. If you would like
further information or background details not specifically detailed in this letter,
please contact me at the above address.

Thank you for your time in reviewing the proposed permit application enclosed.
As acting agent for Mr. &Mrs. Gillings they have indicated to me that they desire to
re-configure their existing floating dock structure. At the present time the existing
boat being 45' is closely encroaching on adjacent properties. The design we have
decided upon would be less obtrusive to either adjacent property owners. As
evidenced in the attached drawing, the proposed floating dock structure would be
32'. This would be quite less than the width the boat now takes up. This proposed
design would take up less side to side space but we are still within the 15' corridor
r CAMA.
If you would please review this design and wave the 15' set back requirement, it
would be greatly appreciated.

Dear Sir:
We DO object to the plan as submitted, not only because of the set back
encroachment, but also because the design belies the intent that a vessel of even
more inordinate size than the present occupant could be berthed in the dock. Based
on the plan, if one uses a boat length factor of 3x beam, then the proposed design
could easily accommodate a vessel of 60' or more. That size boat belongs in a
commercial marina, not a residential dock.
