Dear Sir or Madam:
This firm represents Sanford Doxey, owner of the property located
at 106 S. Channel Drive in Wrightsville Beach. Mr. Doxey' s property is
adjacent to property owned by Jerry A. Cook at 107 S. Channel Drive. On
April 20, 1998, Mr. Doxey received notice that Mr. Cook has applied for
or intends to apply for a permit for a boat lift to be constructed
waterward of his existing floating dock. A copy of the drawing attached
to the notification form is enclosed herewith for your reference.
Mr. Doxey opposes the development proposed by Mr. Cook, and contends
that it violates 15A N.C.A.C. 7H. 0208 (b) (6) (B) , which provides that "T"s
and platforms should cover an area no greater than 500 square feet. The
plan proposed by Mr. Cook would create a total area of 992 square feet
of platform, floating docks, and boat lift, which is nearly twice the
square footage allowed by the rule. Additionally, 15A N.C.A.C.
7H. 0208 (c) (i) provides that development shall not extend beyond the
established pier length along the shore line for similar use. A visual
inspection of the site suggests that Mr. Cook' s proposal does in fact
extend beyond the established pier length along this shore line for
similar use.

Thank you for your comments on behalf of Sanford Doxey concerning the proposed development
by Jerry A. Cook, at 107 South Channel Drive, Wrightsville Beach, in New Hanover County. It is my
understanding Sanford Doxey is an adjacent riparian property owner to 107 South Channel Drive.
The project consists of the addition of a 16' X 14' boat lift to an existing private pier and the relocation
of four existing pilings.
In reference to your April 28, 1998 letter, 15A NCAC 7H .0208 (b)(6)(B) requires that "T"s and
platforms associated with residential piers shall not exceed a total area of 500 square feet. Mr. Cook has
not requested approval to expand this portion of the structure. T15A NCAC 7H .1205 (d) allows an
additional 500 sq. ft. for boat houses (boat lifts). The new boat lift will incorporate an additional 224
sq. ft. of Public Trust Waters out of the 500 sq. ft. additional allowed for boat houses and lifts under the
General Permit. 15A NCAC 7H .0208 (b)(6)(C)(i) requires that piers not extend beyond the established
pier length along the same shoreline for similar use. However, this restriction does not apply to piers 200
feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses
of the waters by the public. Mr. Cook's proposed boat lift addition will create a total structure length
of approximately 110', well under the 200' threshold over which the similar pier length rule would apply.
The structure will not extend beyond the Town of Wrightsville Beach Pierhead Line and should not cause
unreasonable interference with navigation.
Therefor, the project is consistent with our regulations (15A NCAC 7H .1200) which govern the
construction of piers, docks and boat houses in Estuarine and Public Trust Waters Areas of Environmental
Concern. As such, a permit has been issued to authorize the project.
