violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.

confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available

Dear Mr. Flynn,
This is with reference to your request to modify rat‘‘ .; which was issued ta,Michael
Desmond on February 28, 2008 authorizing the reconfiguration of an existing docking facility, which was then
modified on April 25, 2015 for the installation of additional "Jet-Ski" floating platforms. State Permit No. 21-11
is due to expire on December 31, 2015.
The action proposed in your submittal is to allow for the addition of two (2) pilings to an existing boatlift
located on the southern end of the docking facility to increase the lifting capacity required to safely lift the
applicant's new boat.
Upon reviewing the information provided, the Division of Coastal Management has determined that the
proposed action is consistent with existing State rules and regulations and is in keeping with the original
purpose and intent of the permit. This Letter of Refinement authorizes the modification of State Permit No 21-
11 as described in your letter dated September 23, 2013. By copy of this letter we are also notifying the U. S.
Army Corps of Engineers f our action. Please note this refinement does not
alleviate the need to obtain any other local, state or federal permits.
