Dear Ms. Elks: My wife, Betsey Bent, and I own and occupy the home located at 12 West Salisbury Street, Wrightsville Beach,NC, adjacent to the proposed bulkhead and return wall project at 10 West Salisbury Street. The proposed project is to be constructed by Carolina Marine Construction, Inc. of Wilmington,NC ("CMC"). The proposal to which we originally responded by letter dated July, 2020, was provided by CMC, dated June 24, 2020, and received by us a few days later. One of our previous objections was to the stated width of the proposed bulkhead (16 feet) and our request for a survey to determine the correct width of the bulkhead. The Chaffins have had a survey performed (which you previously supplied to me) that appears to be correct, including the stated 11'3" width of the bulkhead. However, the surveyor did not mark the property lines at the MHWL with his stakes and pink ribbons. There are, however, currently"pink flags" placed by Mrs. Chaffins at the CAMA high tide markers: the problem is that in our direction, the "pink flag" appears to be 2-3 feet across our property line. This may be entirely innocent, but we just want to be sure that if the bulkhead is built at the MHWL it will adhere to the correct property lines, which was our previous objection. We also currently object to the proposed project because we still have not seen a plan for this bulkhead and return walls, other than the one submitted by CMC in June, 2020, which was incorrect. I have asked Mrs. Chaffins for a copy of the plan for the project,but I am not sure there is such a plan. This is important to us, in part, because CMC built the bulkhead on the property immediately to our west (the Suprise property), to which we naively consented, thinking that the "plan" submitted to us for consent would be what was built. Unfortunately, this was not the case. a When I asked the contractor why it had not been constructed as shown on the plan, I was told that the plan was an approximation and he built it"where CAMA staked it". We now understand that CAMA does not stake property lines, and I want to be sure that with the Chaffins'bulkhead this does not happen again. One of the problems with the originally proposed"plan" is that it shows the bulkhead being built at the MHWL(as does the recently submitted survey), but does not show how the Chaffins (or their guests) get to the water side of the bulkhead. Mrs. Chaffins has told me she does not know how they will access the beach or the water, is not sure how high the bulkhead will be or how high the return walls will be, except not as high as the Suprise walls. We want to call attention to this problem because if steps, or any other structure, is built seaward from the bulkhead, it appears that the structure will not comply with the 15' setbacks to the adjoining properties. Unless we have seen the plan for this bulkhead and structure before they are built, we shall not consent to any encroachment of the setback requirements. We do not want to be unreasonable, and it certainly seems reasonable to us that we should be able to see a plan for what is contemplated before it is built. We understand that a formal application has not been made at this time, but we have been asked to consent or object to the proposal we received from CMC. We have enclosed a copy of the proposal we received from the Chaffins and CMC. We would also like to review any formal application regarding the bulkhead on this property. In reviewing this proposal, we have also reviewed a 2008 riparian survey of our property which includes neighboring properties, a 2018 survey of our lot when we purchased this property, the subdivision plat and various other surveys and pictures of this area. We have also walked and measured the beach at the MHWL marked at our property and the Chaffins' property, and I had conversations with Ms. Chaffin regarding this proposal prior to receiving the notification from CMC. Because we believe in individual property rights, we do not make our objection to the project, as presented in the proposal, lightly. Our primary objection to this proposal, as presented, is the 16 foot width of the proposed bulkhead because we believe this significantly exceeds the Chaffins' property lines at the MHWL. When this project was first discussed with us, I advised Ms. Chaffin of our concerns that she did not have 16 feet of beach front for this bulkhead.Acknowledging Page 1 of 3 that the amount of beach front property may change with the relocation of the MHWL, our review of the relevant surveys as well as walking and measuring the location on the ground supports our belief that the Chaffins have approximately 8 feet of beach front property. I have shown our survey(s) to Ms. Chaffin with my conclusions regarding the width of her beach front.At one time, Ms. Chaffin acknowledged to me that she had measured it as well and thought she had about 8 feet, or maybe a little more. I suggested to Ms. Chaffin that she should have a survey done to establish the property line intersection with the MEWL so we could be sure that property lines were being respected. I do not know if she had a survey performed, but if so, it has not been shared with us. This is particularly important because the drawing of the proposed project shows that the return walls will run from the outside corners of the bulkhead up the apparent property lines for 50 feet. (The project notification states the return walls will be 40 feet. We are not sure which is intended.)According to the drawing, this would, in effect, establish a new property line which we believe exceeds the deeded property line between our two properties. I talked to Ms. Chaffin on July 12, 2020, and she agreed that we need a survey but was not sure when a survey may be ordered. If the Chaffins and CMC continue to assert that 16 feet is the proper width of the bulkhead, we sincerely believe that the Chaffins and CMC should be required to obtain a certified survey that will establish the accurate width of the Chaffins' beach front at the MHWL. Our second objection is our concern regarding potential erosion on our property resulting from this bulkhead project. We generally believe that bulkheads cause or move erosion, and do not stop erosion. This is particularly true when the homes along this stretch of the sound have such limited beach fronts. We are also worried that with a new return wall, our property will be between two return walls that are 2 to 3 feet higher than our property, creating a potential funnel through our yard for runoff after floods or hurricanes. The proposal does not state the height of the proposed return walls. Our final thought regards the aesthetics of the proposal. Those of us fortunate enough to live on this sound front cove enjoy an unusual and very beautiful beach along the sound. This bulkhead, as presented in the proposal, would negatively affect this beautiful area. This permit shall not apply to shoreline protection along the oceanfront or to waters and shorelines adjacent to the Ocean Hazard AEC with the exception of those shorelines that feature characteristics of the Estuarine Shoreline AEC. Such features include the presence of wetland vegetation, lower wave energy and lower erosion rates than the adjoining Ocean Erodible Area. The applicant shall provide information on site location, dimensions of the project area,and the applicant's name and address. (b) The applicant shall provide: (1) confirmation that a written statement has been obtained signed by the adjacent riparian property owners indicating that they have no objections to the proposed work;or (2) confirmation that the adjacent riparian property owners have been notified by certified mail of the proposed work. The notice shall instruct adjacent property owners to provide written comments on the proposed development to the Division of Coastal Management within 10 days of receipt of the notice, and, indicate that no response shall be interpreted as no objection. The Division of Coastal Management shall review all comments and determine, based on their relevance to the potential impacts of the proposed project, if the proposed project can be approved by a General Permit. If the Division of Coastal Management determines that the project exceeds the guidelines established by the General Permit Process, DCM shall notify the applicant that an application for a major development permit shall be required. (c) No work shall begin until an on-site meeting is held with the applicant and a Division of Coastal Management representative so that the proposed alignment may be marked. Written authorization to proceed with the proposed development shall be issued if the Division representative finds that the application meets all the requirements of this Subchapter. Construction of the bulkhead or riprap revetment shall be completed within 120 days of the issuance of the general authorization or the authorization shall expire and it shall be necessary to re-examine the alignment to determine if the general authorization may be reissued. (b) Individuals shall allow authorized representatives of the Department of Environment and Natural Resources to make periodic inspections at any time deemed necessary in order to ensure that the activity being performed under authority of this general permit is in accordance with the terms and conditions prescribed herein. (c) There shall be no interference with the use of the waters by the public by the existence of the bulkhead or the riprap revetment authorized herein. Bulkheads and riprap revetments authorized in this Rule shall not interfere with the established or traditional rights of navigation of the waters by the public. (d) This permit shall not be applicable to proposed construction where the Division of Coastal Management has determined,based on an initial review of the application,that notice and review pursuant to G.S. 113A-119 is necessary because there are unresolved questions concerning the proposed activity's impact on adjoining properties or on water quality;air quality;coastal wetlands;cultural or historic sites;wildlife;fisheries resources;or public trust rights. (e) This permit shall not eliminate the need to obtain any other required state,local,or federal authorization. (f) Development carried out under this permit shall be consistent with all local requirements,AEC rules,and local land use plans current at the time of authorization. The bulkhead position shall not exceed a distance of five feet waterward of normal high water or normal water level at any point along its alignment. (2) New bulkheads or riprap revetments on shorelines within manmade upland basins,canals,and ditches, shall be positioned so as not to exceed an average distance of two feet and maximum distance of five feet waterward of normal high water or normal water level. (3) When replacing an existing bulkhead, the new alignment shall be positioned so as not to exceed a maximum distance of two feet waterward of the current bulkhead alignment. To tie into a like structure on the adjacent property,replacement bulkhead position shall not exceed a maximum distance of five feet waterward of the current bulkhead alignment. When replacing a bulkhead where lands landward of the bulkhead were lost in the last year,bulkheads shall be positioned a maximum of two feet waterward of the original/existing alignment. (4) Riprap revetments shall be positioned so as not to exceed a maximum distance of 10 feet waterward of the normal high water or normal water level at any point along its alignment. (b) Along shorelines with wetland vegetation, bulkheads and riprap revetments shall be positioned so that all construction is to be accomplished landward of such vegetation. (c) Bulkheads shall be constructed of vinyl, or steel sheet pile, concrete, stone, timber, or other suitable materials approved by the Division of Coastal Management. (d) Riprap revetments shall be constructed of granite,marl, concrete without exposed rebar,or other suitable materials approved by the Division of Coastal Management. (e) Revetment material shall be free from loose dirt or other pollutants. (t) Revetment material shall be of sufficient size to prevent movement from the site by wave action or currents. (g) Construction design for riprap revetments shall take into consideration the height of the area to be protected (i.e. bulkhead height, escarpment height, water depth) and the alignment shall allow for a slope no flatter than three feet horizontal per one foot vertical and no steeper than 1 1 feet horizontal per one foot vertical. (h) All backfill material shall be obtained from an upland source pursuant to 15A NCAC 07H.0208. The bulkhead or riprap revetment shall be constructed prior to any backfilling activities and shall be structurally tight so as to prevent seepage of backfill materials through the structure.1 (i) No excavation, grading or fill shall be permitted except for that which may be required for the construction of the bulkhead or riprap revetment. This permit shall not authorize any excavation waterward of the approved alignment. (j) Runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do no enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence,etc.). (k) If one contiguous acre or more of property is to be excavated or filled, an erosion and sedimentation control plan shall be filed with the Division of Energy, Mineral, and Land Resources, or appropriate local government having jurisdiction. This plan shall be approved prior to commencing the land-disturbing activity. (1) For the purposes of these Rules,the Atlantic Intracoastal Waterway(AIWW)is considered a natural shoreline. (m) Construction authorized by this general permit shall be limited to a maximum shoreline length of 500 feet.
