Dear Jay,
Please find enclosed our proposal for a bulkhead on Lot#36, which is at the
mouth of the channel on the Intracoastal Waterway. By connecting our proposed
bulkhead to the boatowner's existing bulkhead the structure would naturally be
stronger and help prevent further erosion at the mouth of the channel. We are
therefore asking permission to do so and agreeing to bear the full financial
responsibility of construction and maintenance of this bulkhead. Our attorney
drafted and filed a document detailing our proposal and maintenance agreement
to be recorded with our deed to Lot#36. We notified the developer, owner, and
the president of the Homeowners Association of our intentions by certified mail in
July, 1998 but we have yet to obtain a response.
We are requesting a response within ten (10) days of receipt of this letter or we
will proceed with our project and construct the proposed bulkhead without
meeting and/or connecting to the existing bulkhead. As CAMA requires I am also
sending notice to the adjacent property owners. Aesthetically and economically
for the boatowners and ourselves we would prefer to meet and connect to the
existing bulkhead but permission is necessary.

AGREEMENT
NEW HANOVER COUNTY
THIS AGREEMENT, dated as of August , 1998 , is made by and
between DAVID M. GREER and wife, TAMMY P. GREER, individual
residents of North Carolina (collectively, the "Declarants") , and
WILLARD S . BUFFKIN and wife, BEVERLY G. BUFFKIN, individual
residents of North Carolina (collectively, the "Grantees" ) .
WITNESSET H:
WHEREAS, the Declarants executed that certain Declaration of
Covenants, Conditions and Restrictions for Inlet Point Harbor
Development, dated August 15 , 1990 and recorded on August 16 , 1990
at 3 : 36 p.m. in Book 1507 at Page 1290 in the office of the New
Hanover County, North Carolina Register of Deeds (the
"Declaration") ; and
WHEREAS, the Grantees are the owners of the real property
described in Exhibit A attached hereto and incorporated herein by
rcference (the "Property" ) ; and
WHEREAS, pursuant to the terms of the Declaration the
Declarants reserved the right to build a pier and walkway facility
in the marshes lying east of the Property; and
WHEREAS, pursuant to the terms of that certain Amendment to
Declaration of Covenants, Conditions and Restrictions for Inlet
Point Harbor Development, dated November 14, 1990 and recorded on
November 15, 1990 at 2 : 32 p.m. in Book 1517 at Page 0580 in the
office of the New Hanover County, North Carolina Register of Deeds
(the "Amendment" ) , the Declarants eliminated the Declarants' right
to build a pier and walkway facility in the marshes lying east of
the Property; and
WHEREAS, the Grantees now desire to build certain bulkheads
and facilities east of the Property as depicted in the diagram
attached hereto as Exhibit B (collectively, the "Facilities" ) , and
despite the elimination of the Declarants' right to build a pier
and walkway facility in the marshes lying east of the Property
pursuant to the terms of the Amendment, the North Carolina
Department of Environment and Natural Resources has required the
Declarants' consent to the Grantees' plans for the Facilities
before granting a regulatory permit to the Grantees to construct
the Facilities;
NOW, THEREFORE, in consideration of the foregoing and the
mutual covenants contained herein, Lhe parties hereto agree as
• follows :
1 . Consent of Declarantp. The Declarants hereby consent to
the construction and any maintenance and/or rebuilding by the
Grantees of the Facilities .
2 . Maintenance of Facilities. The Grantees hereby agree
that any maintenance of the Facilities shall be at the sole cost
and expense of the Grantees, their successors and assigns .
3 . Covenants Running with the Land; Recording; Governing
Law. The rights and obligations contained within this Agreement
shall run with the land and inure to and be for the benefit of, as
well as be binding upon, the Grantees, the Grantee' s successors and
assigns, and any subsequent owners of the Property, forever. The
parties agree that this Agreement shall be recorded in the office
of the Register of Deeds of New Hanover County, North Carolina, and
that the terms and conditions hereof shall be construed,
interpreted, enforced and governed by and under the laws of the
State of North Carolina .
IN WITNESS WHEREOF, the parties hereto have duly executed this
Agreement , under seal effective as of the date and year first above
written.
