I have no objections to this proposal.
If you have objections to what is being proposed, please write the Division of
Coastal Management, 127 Cardinal Drive Extension,Wilmington, North Carolina,
28405 or call 910-395-3900 within 10 days of receipt oLillis notice. No response is
considered the same as no objection if you have been notified by Certified Mail.
WAIVER SECTION
I understand that a pier, dock, mooring pilings, breakwater, boat house, lift or sandbags
must be set back a minimum distance of 15'from my area of riparian access unless waived
by me. (If you wish to waive the setback, you must initial the appropriate blank below)

Dear Mr. Fitzgerald:
This letter is a follow-up to our recent telephone conversation, with respect to your concerns about
the proposal by Ronald Sinclair to construct a pier on his lot, adjacent to your property, at 119 Beach
Road South, on Figure 8 Island, in New Hanover County. As you will recall from the previous permit
which you received for work on your pier, your floating dock was installed just south of the common
riparian corridor line between you and Mr. Sinclair. Given the 18 feet between the two floating docks,
the proposed structure would not encroach into the 15 feet setback, even though your existing pier is
located at or near the riparian line. The proposed project has been determined to comply with the Rules
of the Coastal Resources Commission (7H.1200), and as such, the Division has issued a CAMA General
Permit for the proposed action. The location of the pier was located in the exact center of the two adjacent
piers to afford the fairest, most equable water access to each property owner.
If you wish to contest our decision to issue this permit, you must file fora contested case hearing
within twenty (20) days. Please contact me at (910) 395-3900, and I can provide you with the applicable
forms and instructions. If you have any questions, or if I can provide any additional information, please
