AGREEMENT �yJ T _ THIS AGREEMENT is entered into this' day of Oc j I=2 , 1998, by and between W & D Knox Enterprises Family Limited Partnership by and through its General Partners, William E. Knox and Diana T. Knox, hereinafter referred to as "Knox," and David W. Mayo, hereinafter referred to as "Mayo." WHEREAS, Mayo owns property at 3 Bay Street, Wrightsville Beach, North Carolina; and WHEREAS, Knox owns the property adjacent to the Mayo property at 5 Bay Street, Wrightsville Beach, North Carolina; and WHEREAS, Mayo wishes to build a new dock that would infringe on the fifteen-foot minimum setback for riparian access of Knox; and WHEREAS, Mayo has asked Knox to waive that minimum setback requirement; and NOW, THEREFORE, the parties wish to enter into this Agreement with regard to the waiver of that setback requirement. The parties hereto do agree as follows: 1. Waiver of Minimum Setback. Knox does hereby agree to sign the necessary document for the waiver of the fifteen-foot minimum setback for riparian access as required by New Hanover County. 2. Dock of Mayo. Mayo agrees that he will build the dock as shown on the attached sketch of the new dock and that he will not infringe on Knox's riparian access for more than approximately eight (8) feet. • , 3. Further Agreement of the Parties. Mayo and Knox agree that Mayo will remove the portion of the dock that infringes on the minimum setback for riparian access of Knox if requested in writing by Knox during Knox's lifetime, or if requested by the heirs, successors or assigns of Knox at any time in the future. Mayo agrees to remove that portion of the dock that infringes on the riparian access within thirty (30) days after receipt of the written request by Knox, his heirs, successors or assigns. 4. Integration. This Agreement represents the full agreement of the parties and no other representations, oral or written, shall be binding on the parties with regard to this matter. 5. Binding Effect. This Agreement shall be binding on the parties, their heirs, successors and assigns. 6. Governing Law. This Agreement shall be governed by the laws of the State of North Carolina.
