My Qualified Approval: To avoid the likelihood of killing the large cedar tree on our 9 Oyster Catcher property (in the northwest corner), Larry, during our phone conversations on this date, has agreed to consider reasonable measures to save the tree. Our approval is contingent on selecting one of the two following options for the bulkhead return wall in the southwest corner: (1) The length be no longer then 10 feet from the rear bulkhead, or (2) If the length is beyond 10 feet that it be located approximately 10 feet from the base of the tree or approximately 8 1/2 feet from the property line. Either of these two reasonable options, recommended to me by a professional landscaper that is active on the Island, will prevent cutting up the cedar tree's root system and minimize the cutting down of a substantial number of large branches that extend over the property line. I want to thank Larry for his sensitivity and cooperation in saving this large cedar tree that beautifies both of our properties and Oyster Catcher. The proposed bulkhead includes wing walls up the property lines to retain fill material that will be imported to the lot in preparation for residential construction. The proposed project has been determined to comply with the Rules of the Coastal Resources Commission (7H.1100), and as such, the Division has issued a CAMA General Permit for the proposed action. I have'enclosed a copy of the rules which govern the issuance of permits for bulkheads and the placement of rip rap (rock). If you wish to contest our decision to issue this permit, you must file for a contested case hearing within twenty (20) days. I have enclosed the applicable forms and instructions that must be filed prior to that deadline.
