SECOND AMENDMENT TO DECLARATION OF
• COUNTY OF NEW HANOVER COVENANTS,CONDITIONS AND RESTRICTIONS
INLET POINT HARBOR DEVELOPMENT
This Amendment is made this C day of --T7 cuLd, ,2000
,by KATHLEEN G. EAGLE (formerly Kathleen G.Buffkin) referred to herein,and in the
Declaration recorded in Book 1507 at Page 1290 in the New Hanover County Registry as
"Declarant". .
WHEREAS,by that Declaration of Covenants,Conditions and Restrictions of Inlet Pdurt
Harbor Development recorded in the New Hanover County Registry on August 16, 1990 in Book
1507 at Page 1290 certain covenants and conditions were declared and made applicable to the
property, lots,roads, streets and common areas described in map recorded in Map Book 31 at
pages 134 through 139,known as Inlet Point Harbor Subdivision;and
WHEREAS,an Amendment to Declarations of Covenants,Conditions and Restrictions of Inlet
Point Harbor Development made certain minor modifications,corrections and clarifications to. .
some of the terms contained in the said Declaration,which Amendments were recorded in Book
1517 at Page 580 of the New Hanover County Registry;and •
WHEREAS,the Declarant desires to make certain minor modifications,corrections and •
clarifications to some of the terms contained in the said Declaration,and that first Amendment,and
so makes this second Amendment;and
NOW THEREFORE,the undersigned Declarants do hereby modify and amend the
Declaration by making the following changes:
1. Article II Section 3,first paragraph,second sentence is deleted to remove the Developer's
retention of right to build ramps,floating docks,piers and slips in the waterway adjacent to Lot 35.
The Developer does further hereby release and negate any pedestrian easement as shown on the
plat of the said Lot 35 or that may have been inferred from the Plat of Lot 36. The property
previously retained as a pedestrian easement over Lot 35 does and hereby is made to become part
of the Lot 35 to be used at the sole discretion of the Purchaser of said Lot 35. The owner of Lot
35 shall have the full right to construct such ramps,floating docks,piers and slips for their own use
at their own expense,adjacent to Lot 35.
Except as specifically changed herein the said Declaration of Covenants shall remain in full force
and effect. If there are any inconsistencies between this Amendment and the original Declaration,
this Amendment shall control.

Dear Mr. &Mrs. Buffkin,
Enclosed is a proposed second Amendment to the Restrictions which allows you to bi
private dock for Lot 35. This would be executed on the condition that you will not claim any i
slips that are not adjacent to your Lots 35 and 36. I wiil reassign the present slip you are using
(# 8 ) to the lot owner of my choice.
The construction of all boat slips adjacent to Lot 35 and Lot 36 shall be at your expen
and the Boat Owners Association and developers have no ownership rights in such boat slips.
The dues payable by you to the Boat Owners Association shall remain the same for e�
lot, however, the Boat Owners Association shall not have any obligation to repair or replace s
piers, pilings, floating docks, walkways and boat slips as you construct. The Boat Owners
Association will continue to maintain, repair and/or replace all bulkheads adjacent to your lot
the same manner they would for other property owners with bulkheaded lots built by the
developer. This does not include bulkheads you have constructed at your expense on Lot 36.
