Since that time, we have met with Mr. Johnnie Baker DBA Bridge Tender Marina and have reached a satisfactory arrangement relative to that project. Mr. Baker has agreed to locate the floating dock not less than 20' off the common property lines, which will allow sufficient movement by boats entering and leaving Airlie Marina, and accommodate boats while dining at the Fish House Grill. Enclosed are copies of support data including: 1. A plan which shows the"as presently built" structures for slips#39-47. 2. A proposed plan which shows the new location of the dock and the arrangement of slips#39-47. We do not plan to add any more slips under this request than are now present. This plan reflects a 20' set back from the common property line with MJR Properties/DBA Airlie Marina as agreed to with Mary Wilson and Tom Dickey. 3. A detailed plan from Sound Marine, who is in agreement with Jimmy North and will be constructing and placing the new docks in position as detailed. I strongly object to the proposed changes shown in his drawing of November 1999. The owners of said property-MJR Properties concur as signified by the signature of MJR's managing owner below. The first problem with the proposal is the location of the property line.The drawing shows the property line about seven feet from the existing deck and parking lot. The latest survey the owners had done(copy enclosed) puts the property line about one foot from the existing deck. This should be resolved before any further consideration is given to the permit. This marina has been in this location in the present configuration since 1978. The original plan approved by the Corps of Engineers AND by the former owners of the Fish House property is enclosed.Mr. Baker tore down the original fixed pier and put in floating docks with the boat slips on the Southwest side. This arrangement allows boaters at both marinas to get their boats out of their slips. Under the proposed configuration it will be difficult for the boat owners at my marina to get out of their slips. If a boat or boats tie up alongside the relocated dock on the Southwest side it will be nearly impossible. Since the Fish House is a restaurant this is a frequent occurrence,particulary on weekends. In effect,this proposed change will have a severe economic impact on me and the property owners if I have to go out of business. It would appear that Mr. Baker wants more room for even larger boats to get out.but at my expense. It would seem to me that a marina that has been here for 21 years should not be adversely affected by the proposed change. If Mr.Baker needs 50 foot slips,he can simply move the existing floating dock a few feet to the Northeast. A copy of a city, county or state roadway map will be acceptable. • A copy of any existing survey and tax map, if available in the county wherein the adjacent riparian land is located, showing or depicting the adjacent riparian or littoral land owned by the applicant. The tax map can be obtained from the tax office in the county wherein the land is located. • An accurate, dated work plat drawn to scale in black ink on 8 1/2" by 11" white paper that shows or depicts the following information: a The mean high water line and the linear feet of riparian shoreline utilized in calculating the riparian credit referenced in section 5 of this application. b. The footprint and total square footage of all structures, including mooring pilings, located in or over state-owned lands covered by navigable waters. THE FOOTPRINT SHALL INCLUDE (AND THE WORK PLAT MUST REFLECT) THE TOTAL SQUARE FOOTAGE OF THE AREA OF STATE-OWNED LANDS COVERED BY NAVIGABLE WATERS THAT ARE ENCLOSED ON THREE OR MORE SIDES BY ANY STRUCTURE. The dimensions of all structures located in or over state-owned lands must be depicted on the plat. Note: Examples of plats showing structures located in or over state-owned submerged lands are provided to assist you in determining the footprint area. See attached Exhibits A and B. c. The owners name and project name, if any, and the recordation information (e.g., Deed Book and Page, Will Book and Page) of the instrument through which the applicant establishes ownership to the adjacent riparian or littoral land. d. The north arrow and scale used in drawing the plat. If the applicant is unable to depict the required information on one (1) sheet of 8 1/2" by 11" white paper, include additional sheets with appropriate match lines. A legible, copy of a larger plat reduced to 8 1/2" by 11" on white paper, which includes a scale, will also acceptable. Note: The work plat will be attached to and incorporated by reference to the Easement granted by the state. Therefore, it is essential that the required information depicted or shown on the plat be legible and accurate. • A copy of any required CAMA Permit authorizing construction or erection of new or existing structures, if the structure(s) were constructed or erected on or after March 1, 1978. If the structures were constructed or erected after March 1, 1978, and applicant is unable to include a copy of the required CAMA permit, an easement will be issued only if the Division of Coastal Management(DCM) certifies: (1) A CAMA permit was issued for such structure(s); or (2) The structure(s) could have been permitted under CAMA development standards in effect at the time the structure(s) were erected; and there are no outstanding or unresolved matters relating to a Notice Of Violation (NOV) or civil penalty assessment issued by the Division of Coastal Management regarding such structures. 5. As you are aware,the CAMA rules require that any structures including the pilings that are permitted be located a minimum of 15' inside the property line extension. Our joint property line extension is not perpendicular to the waterway, which is also a requirement in the permit process. I do not plan to give up any of my property and certainly do not expect you to either. It is for that reason that the plan we submitted shows more than 15' set back on the west side of our joint property lines. I understand that you have expressed concern about boats docking side-to while eating at the Fish House Grill. By observation, I can assure you that the only boats that use the floating dock for that purpose are small outboards that are usually less than 7' wide and should not be a restriction to movement by your boats, since we would still be 20' off the line. I am interested in cooperating with you in this matter as we discussed last week and will agree to set back not less than 20' for the location of our floating dock from the joint property lines with your withdrawal of objection to our project. I will also agree not to challenge any oversight that might exist in the present location of your northern dock and the pilings as presently constructed. My alternative to this cooperative solution for everyone is to process a major CAMA permit which will be time consuming and result in construction going on in the summer months.
