This agreement is between Jeffrey H. Blackwell and Suzie S. Blackwell (hereinafter
"Blackwells") and Timothy M. Bourne and and Shannon R. Bourne (hereinafter
"Bournes"). Blackwells are the owners of Boat Dock#16, Shandy Point. Bournes are
the owners of Boat Dock#17, Shandy Point.
For and in consideration on these premises and other valuable consideration, hereby
acknowledged by these parties, the parties agree as follows:
The boundry of the riparian rights between various lots in the Shandy Point boat basin
(including the adjacent lots owned by Blackwells and Bournes)are in dispute. This
agreement is intended to allow Blackwells and Bournes to proceed with improvements to
their property and to document the agreement that has been reached.
Two pilings currently exist between the docks of Blackwells and Bournes. The location
of these pilings are shown on the attached survey. They are marked and referred to as
Piling A(furthest from the bulkhead) and Piling B (closest to the bulkhead). Pursuant to
this agreement, piling A will be relocated with a center three and one-half feet to the
Bourne side of a line drawn from the center of the current piling to the property line on
the new bulkhead and approximately four feet closer to shore(or as otherwise agreed
upon by the parties). Piling B will be relocated as agreed upon by the parties. In the
event of a disagreement between the parties, regarding the location of Piling B, Bournes
shall have the final decision as long as the piling is not moved closer to the Blackwell
property.
At the expiration of ten (10)years from the date of this agreement and for a period of two
(2) years thereafter, Bournes, at their option, may relocate the piling to its present
location or another location, so long as it is not closer to the Blackwell property than its
present location, provided that they obtain the required permitting. Blackwell's hereby
agree to execute any documents necessary to the permitting process and waive any
objections that may arise as a result of this piling relocation addressed by this agreement.
Neither party shall be prejudiced by the above indicated relocation of the pilings and all
statute of limitations or other potential time bars are waived between the two parties.
This agreement shall be binding on the Blackwell heirs, successors and assigns. It is
intended to run with the property rights of Boat Dock 16, Shandy Point.
