Dear Mr. Brooks:
I received the original of the enclosed Adjacent Riparian Property Owner
Notification and Waiver Form by certified mail on July 21, 2000. It was mailed on July 5,
2000, but not delivered until the 21 st because I was out of town until the night of the 20th
of July. The form calls for the sender to be notified within 10 days of receipt by the
addressee if there are objections. I intend to object, and I believe I have qualified to do
so under the "10 days from receipt"requirement which will be proven when the return
receipt form is received by the sender.
My objection stems from observing the construction of a house at 8 Oyster
Catcher where bulkheading was apparently approved by the adjacent property owners. It
has a bulkhead five feet above natural grade which allows the concrete slab under the
house to be a few feet higher even than the height of the bulkhead. The obvious purpose
of elevating the working ground level of the house is to avoid the storm surge that occurs
during hurricanes. I can understand the intent of that homeowner and, I suspect, that of
the property owner at 9 Oyster Catcher who apparently would like to do the same thing if
I approve.
What bothers me about bulkheading is that the surrounding houses and streets that
are basically at natural grade level will take a greater amount of water during storm
surges while those houses allowed to be elevated above flood levels will remain
undamaged by the flood. The runoff from those elevated lots will collect in the streets
which are not built to handle the extra water and will run across my lot and all the others
at natural grade adding to the damage that occurs. I know, I've observed the damage from
the last six storms which have hit the Wilmington area and my house, and I know that the
rapid return of the flood waters to the marsh is what causes the most damage to
landscaping and structures.
The Homeowners' Association of Figure Eight Island is well aware of the
potential problems bulkheading in our neighborhood can cause to its streets and right-of-
ways and to the existing homes on natural grade. A policy should be forthcoming from
the Board of Directors which, I hope, will deal with the authorization of bulkheading on
the unimproved properties in the Oyster Catcher neighborhood. If a bulkhead is allowed
on 9 Oyster Catcher which runs down my property line, I fear that I will have no choice
but to look into building my own bulkhead and raise my house to the same height of
those at 8 and probably 9 Oyster Catcher to avoid the extra flood water. Will that start a
domino effect with regard to the house on the other side of me at 11 Oyster Catcher and
so on down the street?That is why I have asked the Homeowners' Association to
consider a policy prohibiting bulkheading in our neighborhood, or cause a collective
decision to be made that to protect our houses in the future, we all must take measures to
elevate our houses. Having been through several storm surges, I don't think that should
be necessary and I think bulkheading in the Oyster Catcher neighborhood is a very bad
idea.
If there are CAMA hearings on this specific request, I expect to be notified and
will attend to state my concerns. Please advise me as to what the next step is. Otherwise
you are on written notice confirming a voice mail left with you today that I object to the
request in the enclosed waiver form until a community decision can be made on the
issue of bulkheading in our neighborhood.

This letter is in response to your July 24, 2000 correspondence, with respect to your concerns
about the proposal by Mr. John Thomas to construct a bulkhead on his lot, adjacent to your property, at
9 Oyster Catcher Road, on Figure 8 Island, in New Hanover County. The proposed project has been
determined to comply with the Rules of the Coastal Resources Commission (7H.1100), and as such, the
Division has issued a CAMA General Permit for the proposed action. I have enclosed a copy of the rules
which govern the issuance of permits for bulkheads and the placement of rip rap (rock).
If you wish to contest our decision to issue this permit, you must file for a contested case hearing
within twenty (20) days. I have enclosed the applicable forms and instructions that must be filed prior to
