TWSP 7 Sewer Force Main Improvements
Applicant: City of New Bern
Dear Brad:
On behalf of the City of New Bern, Land Management Group is submitting a CAMA General Permit
application for the installation of a 12" sewer force main under three Public Trust waterbodies,
Lawson Creek, Trent River, and Scott Creek, in Craven County. The purpose of the project is to
provide wastewater service to a portion of Township 7 in New Bern, NC. This project will remove a
portion of the flow from the Township 7 community that is currently being pumped through an
existing 8-inch force main. The project will also replace the existing Pump Station #10 with a flood -
proof wet well and valve vault and elevate controls above the 100-year base flood elevation. A 12"
water line will also be installed under the Trent River. The lines will be installed under the streams
via horizontal directional drill within an existing public utility easement. Additionally, a portion of
the sewer line will be installed via open cut methodology through uplands within the CAMA AEC
just north of the Lawson Creek crossing (see Figure C-13).
This application requests CAMA General Permit 0.1600 to authorize the installation of the sewer
line underneath these public trust waters via directional drilling. Most of the entry and exit points
for the directional drill will be located outside of the public trust waters boundaries and the pipe
will be located a minimum of 6 feet below the bottom of the streams. LMG delineated wetlands
within the project area. Since these waterbodies are classified as Section 10 waters and because
0.05 acre of temporary wetland impact is requested, a permit is being requested from the US Army
Corps of Engineers for the project.
The adjacent riparian landowners to the crossings at the location of the public trust waters have
been notified and copies of the notification letters are included in this application. The green cards
will be forwarded to your office as soon as they are received. Additionally, an application fee of
$400 is enclosed.

THIS EASEMENT ("Easement"), made and entered into as of the date set forth in the
notary acknowledgment below, by and between the STATE OF NORTH CAROLINA, a body
politic and corporate, hereinafter referred to as GRANTOR, and CITY OF NEW BERN, a
municipal corporation of the State of North Carolina, hereinafter referred to as GRANTEE;
WITNF,SSETH:
THAT, WHEREAS, the North Carolina Department of Administration, has authorized
and approved the execution of this instrument for the purposes herein expressed; and,
WHEREAS, the execution of this instrument for and on behalf of the State of North
Carolina has been duly approved by the Council of State by resolution adopted at a meeting held
in the City of Raleigh, North Carolina, on the 7n' day of November, 2017.
NOW, THEREFORE, in consideration of the sum of TWO HUNDRED FIFTY and
NO/100 DOLLARS ($250.00), and other good and valuable consideration, the receipt of which is
hereby acknowledged, the Grantor does hereby grant unto Grantee, its successors and assigns, the
right, privilege and easement to construct, install, operate and maintain a pump station and
twelve (12) inch subaqueous wastewater force main as part of Grantee's Township #7 Sewer
Improvements Phase III Project, with accessories and appurtenances necessary in connection
therewith (hereafter collectively referred to as the "Facilities") under and across the Trent River,
situated in Township #7, Craven County, North Carolina, and more particularly described as
follows:

(Deed Book 981, Page 72, Craven County Registry), said point being located at
the mean high water mark of the Trent River, and having NC Grid Coordinates
(NAD 83/2011) of N: 497,126.61 and E: 2,584,112.75; thence from said point of
beginning crossing the Trent River, South 51 degrees 58 minutes 54 seconds East,
as distance of 1,846.80 feet to a point in the western line of property of Trent
Villas Dock Owners Association, Inc. (Deed Book 3165, Page 719, Craven
County Registry), and the mean high water mark of the Trent River; thence along
and with the western line of said property of Trent Villas Dock Owners
Association, Inc., and the mean high water mark of the Trent River the following
three courses and distances: South 20 degrees 41 minutes 24 seconds East, a
distance of 1.05 feet; South 33 degrees 27 minutes 57 seconds East, a distance of

6. It is further understood and agreed that this conveyance is made subject to the
condition that Grantee shall properly obtain all necessary permits required by State and federal
law. Failure to obtain such permits in a timely manner shall be deemed an abandomnent of this
Easement.
TO HAVE AND TO HOLD the aforesaid rights, privileges and easements unto said
Grantee, its successors and assigns, for so long as Grantee maintains the Facilities and no longer.

notary acknowledgment below, by and between the STATE OF NORTH CAROLINA, a body
politic and corporate, hereinafter referred to as GRANTOR, and CITY OF NEW BERN, a
municipal corporation of the State of North Carolina, hereinafter referred to as GRANTEE;
WITNESSETH:
THAT, WHEREAS, the North Carolina Department of Administration, has authorized
and approved the execution of this instrument for the purposes herein expressed; and,
WHEREAS, the execution of this instrument for and on behalf of the State of North
Carolina has been duly approved by the Council of State by resolution adopted at a meeting held
in the City of Raleigh, North Carolina, on the 7" day of November, 2017.
NOW, THEREFORE, in consideration of the sum of TWO HUNDRED FIFTY and
NO/100 DOLLARS ($250.00), and other good and valuable consideration, the receipt of which is

located at the mean high water mark of Lawson Creek, and having NC Grid

said point of beginning crossing Lawson Creek, South 8 degrees 23 minutes 59
