sand from the canal in front of 106 Boryk Avenue at Top Sail Beach.

I DO NOT AGREE AND OBJECT TO MR.TAYLOR'S PLAN FOR REMOVING SAND FROM THE FRONT OF HIS
PROPERTY. HE HAS A PROBLEM IN THAT MY PROPERTY WAS NOT DREDGED DURING THE LAST DREDGING
MAKING AN UNDERWATER HILL IN FRONT OF MY PROPERTY;WHICH IS CONTINUING TO MOVE INTO HIS
AREA. UNLESS MY SAND IS REMOVED AT THE SAME TIME HIS IS DREDGED MIGRATION WILL CONTINUE.
ATTACHED IS THE LE 1 I ER THAT LED TO A COURT DATE WITH MR.WATERS. MR.WATERS TESTIFIED THAT
MR.TAYLOR AND OTHERS MADE COMPLAINTS TO JANET RUSSELL STATING THAT MY SAILBOAT WAS TOO
BIG FOR THE CANAL,I DIDN'T USE IT ENOUGH,ETC. MS.RUSSELL DID WRITE A LE 1 1 ER TO THE COURT
STATING SHE DID STOP THE DREDGING ON MY PROPERTY WHICH FORCED ME TO MOVE MY SAILBOAT. ALL
THE SURROUNDING PROPERTIES WERE PROPERLY DREDGED BY MR.WATERS.
I WOULD LIKE YOU TO COPY WHAT YOU HAVE IN THE FILE FOR OUR CANAL UNDER THE FREEDOM OF
INFORMATION ACT. I INTEND TO FILE SUIT AGAINST MR. TAYLOR AND MY NEIGHBORS FOR THE COST PAID
FOR DREDGING,LOSS OF USE OF MY BOAT DOCK AND MY RENTAL PAYMENTS FOR STORING THE SAILBOAT
ELSEWHERE. OTHER FACTORS ARE ALSO BEING CONSIDERED.
I WOULD LIKE TO FILE A COMPLAINT REGARDING MR.TAYLOR'S DOCK. I ASSUME HE HAD PERMISSION
FROM MS. RUSSELL TO BUILD THE DOCK BEYOND THE 10 FOOT DOCK RESTRICTION;WHICH IS ON ALL OUR
DEEDS. HOWEVER,I WAS NEVER CONSULTED OR GIVEN THE CHANCE TO APPROVE OR DISAPPROVE HIS
DOCK SIZE. NOW,WITH HIS TWO,LARGE BOATS WHICH EXCEED A TOTAL OF 40'HIS DOCK EXTENDS WELL
BEYOND A THIRD OF THE CANAL WHEN USING THE DOCKING. FURTHER,A LIKE DOCK WAS BUILT ACROSS
THE CANAL FROM HIS DOCK;WHICH MAY HAVE BEEN APPROVED BY MS.RUSSELL AS WELL. THIS IS NOW A
HAZARD. IT WOULD BE DANGEROUS TO TRY TO MOVE MY SAILBOAT IN AN OUT DURING WINDY
CONDITIONS. WHAT CAN I DO? LET ME KNOW.

CAUSE OF COMPLAINT:FAILURE TO COMPLETE DREDGING CONTRACT
I ENTERED INTO A JULY 1998 CONTRACT FOR DREDGING THE AREA NEXT TO MY DOCK ALONG WITH OTHER
PROPERTY OWNERS NEEDING THE SAME REMOVAL OF SAND FROM HURRICANE FRAN. IN MY CASE,I DOCK
A SAILBOAT WITH A FOUR FOOT DRAFT(4'). TOM WATERS AGREED THAT THERE WOULD BE ADEQUATE
CLEARANCE AT LOW TIDE TO BACK AWAY INTO THE DEEPER PART OF OUR CANAL.
MR.WATERS EXPECTED AND RECEIVED A$1,000 ADVANCED PAYMENT ON 11/25/98 AND ASKED FOR
FURTHER PAYMENT TWO DAYS BEFORE CHRISTMAS DESPII'h THE FACT HE HAD NOT COMPLETED WORK
FOR ALL OF US ON THE CANAL. (SEE ATTACHED CONTRACT AND PAYMENTS.)NOTE ON THE 12/23/98 CHECK
OF MY REMINDER TO HIM THAT HIS WORK WAS NOT DONE(NOT 4'AT LOW TIDE).
THE 33'SAILBOAT WAS BROUGHT BACK IN THE SPRING BY TONY WILLIAMS AND HE REPORTED HITTING
BOTTOM IN THE MIDDLE OF THE CANAL NEAR HIGH TIDE. ALSO,THAT THERE WAS NOT SUFFICIENT DEPTH
AT THE DOCK TO HANDLE THE KEEL DEPTH. THE FLOATING DOCK HAD BEEN REMOVED AND REPLACED AT
A COST OF$350 BUT NOT SUFFICIENT AMOUNT OF SAND WAS REMOVED TO KEEP THE DOCK OFF THE
BOTTOM. WHY REMOVE THE DOCK AND PILINGS IF THE SAND WAS NOT GOING TO BE REMOVED TO FLOAT
THE DOCK AND THE SAILBOAT?
ENCLOSED ARE PICTURES SHOWING THE CURRENT SITUATION.
SUMMARY STATEMENT:
I HAVE TRIED MANY TIMES IN THE PAST TO GET MR.WATERS ON THE PHONE WITH NO SUCCESS. THREE
WEEKS AGO MY NEIGHBOR SUGGESTED WE HIRE MR.WATERS TO FINISH THE DREDGING JOB HE STARTED.
TO MAKE A STORY SHORT,MY NEIGHBOR STATED THAT MR.WATERS WAS STOPPED ON THE JOB BY JANET
RUSSELL,CAMA,REPRESENTATIVE,AND HE WAS UNABLE TO CLEAR THE CENTER OF THE CANAL AND MY
PROPERTY DUE TO HER INTERFERENCE. I BET VE HE SHOULD HAVE TOLD ME IF THAT WAS THE FACT AND
GIVE ME A CHANCE TO BACK OUT OR ADJUST THE CONTRACT BASED ON HIS INABILITY TO PERFORM.

According to C.A.M.A. regulations I am required to "provide signatures of no objection
from both adjacent riparian property owners as well as written waivers of the required 15
foot setback"for any improvements, dredging or maintenance of my dock or portion of
canal.
I am planning to have my portion of the canal dredged and am planning to install a boat
lift adjacent and parallel to my floating dock next to the Clark's property line. The
boatlift will not infringe on any portion of any imaginary line extending into the canal (at
a 45 degree angle) from our mutual property line or corner of the canal.
If you have "no objections"to the above statement and you agree to waive the required
15-foot setback, please indicate by signing and dating this document below.
