Dear Mr. Reel: Thank you for your comments received .on February 13, 2001 concerning the proposed development adjacent to your property. The development is proposed by.Lacy Pridgen, Jr. at 105 Alexis Hale Drive adjacent to Moores Creek near Currie in Pender County, NC. The project consists of the construction of a boatramp located on the applicant's property near the property line that separates his property from yours. The project is consistent with our regulation (T15A:07H.1300 copy enclosed) which authorizes a General Permit for the construction of boat ramps along estuarine and public trust shorelines and into estuarine and public trust waters. The proposed boat ramp meets the dimensions, guidelines, and conditions as set forth within 7H.1300. The 15 foot setback mentioned in your letter does not apply to boat ramps. Also, the Division cannot assume that the boatramp will cause erosion on your property. If that becomes the case, it will likely be a civil matter that may need to be settled in court. Since you may wish to appeal this decision to the Coastal Resource Commission, I have enclosed the appropriate forms. A third-party appeal must be filed within 20 days of the issuance of the permit. I would like to have some sort of clarification of this form concerning if the 15 feet setback applies to boat ramps.There is nothing enclosed with this form as to what plans Mr.Pridgen has for his property. This is concerning a boat ramp&pier being built on Moore's Creek,just 1100 feet from the Black River, in western Pender County.The purpose of this letter is to voice our concern over this matter. It seems strange to me that he has decided to inform me of his intention to build said boat ramp,by letter, only after the state of NC,and the US Army Corps of Engineers investigated that he had none of the legally required permits.How is this possible,that he is allowed to pour concrete,with no permits? My main concern,is,what about the increased run off into the river?Not to mention the erosion of the already unstable shoreline? Also the increased boat traffic. At the angle of this boat ramp,runoff will have no trouble entering into this creek at a breakneck speed!! What will happen to this pristine body of water that feeds into the Black River?Will this lead to the runoff of dirt,fertilizer and God knows what else into this creek?This body of water is affected by the tidal changes. We see this everyday. This is supposed to be one of the cleanest bodies of water in the state!! We sure would like to see it stay this way!!! My wife&I are very concerned that with the construction of the boat ramp being in such close proximity of our property,that erosion will inevitably start!! When this starts,who will protect our investment? Will the state on North Carolina or Mr. Pridgen be willing to pay for any erosion to our property? I for one do not wish to keep Mr.Pridgen from enjoying his property,but I do not wish to have a public boat landing next door to our home. According to Mr. Pridgen,he plans on clearing another 2J3rds of an acre for himself&friends to park their trucks&boat trailers. Will we see RV's&motor homes next? Are we about to see a campground built in a residential neighborhood?According to Mr.Carl Evans, (deceased),the previous owner of the property,there is a recorded easement in the Pender County Register of Deeds Office to said property. Mr.Evans spoke with my father in law&myself many times during the 1-3 years he lived next door about the fact that he didn't wish to see a boat ramp built,not to mention the fact that he did not purchase the permits for a boat ramp. If this is the case,then the road can't be closed off,and we will end up with a public boat ramp,in a residential area!! My wife&I can't stand for this!!! We've decided to live here,if nothing else,then for the peace&quite, after all,this is our home!!! If we had wanted to live next door to a public boat ramp,we would have built next door to a NC Wildlife boat ramp!! It seems so strange that the NC Wildlife Commission was attempting to build a boat ramp on Moore's Creek last year and they were told that it could not be done. Our main concern is the runoff into this creek,which feeds into The Black River. We are just a mere 1100 feet from it. This is of great concern to us. Not to mention the other concerns we have.The increased risk of erosion to our property. Will someone be willing to repair the possible erosion to our investment?Not to mention the fact that it is within 3 feet of our property.With the increased boat traffic,erosion is sure to worsen!!
