I learned that you do not intend to have all the repairs to your bulkhead made upon approval of your permit but may delay the repairs to the portion of the bulkhead from the offset to the boat basin for a year or more. As you know, I signed your requested consent to CAMA for the permit based upon my understanding that the intrusion into the canal from the offset to the river would be offset by moving the bulkhead landward from the offset to the boat basin. I'm relying on your agreement that the repairs to the bulkhead from the offset to the canal when made will be made as shown on your permit drawing that I have consented to. I understand that all of the repairs to the bulkhead immediately will be would be expensive and I understand your desire to defer the most expensive portion of work from the offset to the boat basin along the canal. I understand from your drawing that you will make repairs to the bulkhead from the intersection with the Tayloe bulkhead along the river and then along the canal to the intersection with my bulkhead in the boat house section. You are proposing to extend the bulkhead along the canal from the river into the canal by 20 inches to the point of the offset in the current bulkhead and then from there 20 inches inside the existing bulkhead landward to the point of intersection with my bulkhead. My only suggestion is to make the corner where the bulkhead turns towards the boat house a 45° angle rather than the 90 as it is now. While the canal will be narrowed to the point of the offset a 45 would help the river flush the stagnant water from the boat house section of the canal and reduce the toxic algae blooms in the summer. It would give you better access to your boat lift and help me and others make the turn toward my bulkhead without reversing. As I said before, having fresh water in the canal, without toxic algae, that is usable for recreational purposes, with clean water, less flooding and good access to your boat lifts, the boat ramp and my bulkhead will benefit you and the value of your property as well as mine and the public. In order to respond, please send me a drawing of exactly what you are proposing so there is no misunderstanding. A markup of a copy of your survey would be good. CAMA will require something similar for the permit to show the location and dimensions of the project. You will want that for your contractor as well. I understand from your email that you are proposing to proceed with repairs to the bulkhead on the river and are proposing not to do any work or repairs to the bulkhead along the canal. So we don't have to go through this exercise again in a month or a year or with the next owner should you decide to sell, I would like an agreement that any further repairs to the bulkhead (including the portion you are proposing to repair now) will be made behind the existing bulkhead with no further intrusion into the public waterway. While repairs to the bulkhead made behind the existing bulkhead may be inconvenient, perhaps more expensive and may damage your grass, your grass will regrow but further intrusions narrowing the public waterway will do irreparable damage to the canal we share with the public. Protecting the public waterway is important. Having fresh water in the canal, as opposed to toxic algae during the warm months of summer will be important to you. In the long-run, having a canal that is usable for recreational purposes, with clean water, less flooding to our property and good access to your boat lifts, the boat ramp and my bulkhead will benefit you and the value of your property as well as mine and the public. As you know Washington Park recently spent $50,000±to address the flooding, drainage issues to the canal. our property and private road. I'm glad you appreciate that protecting the canal is important. CAMA's regulations provide that bulkheads shall not interfere with the established and traditional rights of use of waterways by the public. There is a work-around that can result in replacement or repair of your bulkhead without further intrusion into the canal. Again, I learned of the proposed replacement bulkhead on 1/16/21.and responded to you on the 17th. I am responding to your update I received yesterday. The canal is our waterfront. It is the reason we bought the house sixteen years ago. You know we use the canal for boating, rowing and small boat sailing. Further unchecked and repeated nar- rowing of the canal will make sailing to my bulkhead more difficult if not impossible and do ir- reparable damage to a navigable waterway. Others in the community use the canal for fishing and recreational purposes. There are bass boats in the canal every weekend. Multiple Intrusions. The bulkhead along the canal adjacent to your lot has been replaced at least twice if not three times. Each time narrowing the canal by 3 to 4 feet. That may explain the 5 ±foot offset at the midpoint of the bulkhead on your property on the western side of the canal. The bulkhead on the eastern side of the canal has been replaced at least twice and most recently within the last year. Each replacement of the bulkheads along the eastern and western side of the canal has reduced the width of the canal by 3 to 4 feet. The canal is con- siderably narrower now than it was when our houses were built — probably by 10 to 15 feet. Before multiple replacements and intrusions into the canal, Mr. Hackney moored a 40 foot± yacht in the navigable waterway. That could not be done today. Decreased Water Quality. With each bulkhead replacement and intrusion into the canal the flow of fresh water to the canal from the river has been reduced. That has and significantly af- fected the water quality of the canal. Stagnant water has increased organic matter in the ca- nal and resulted in toxic algae blooms in the warm summer months in recent years. Increased Flooding. The canal serves as storm water drainage for the easternmost part of Washington Park. It is the outfall to the river for a series of Washington Park drainage ditches throughout the immediate area. Reducing the flow to the river from the drainage ditches backs water up in the drainage ditches contributing flooding adjacent properties. The com- pounding effect of narrowing the canal with each bulkhead replacement has increased flood- ing of my property and other nearby properties and extended the time for flood waters to re- cede. This situation will only get worse over time. Must Balance Interests. Property owners and CAMA must balance the interests of those who use the canal for boating access, recreational purposes and enjoy the view of the river the canal provides with your need to maintain your bulkhead and how that maintenance is done. This should be accomplished through cooperation and a rigorous permitting process. A bulkhead contractor's concern is not to balance these interests. Work-Around. I do not object to repair of the bulkhead provided the repair or replacement is behind the existing into the canal.bulkhead and does not result in further intrusionMainte- nance of the bulkhead can be done that is not at the expense of the navigable waterway. The compounding effect of multiple replacements of the bulkheads on both sides of the canal has negatively impacted our ability and that of others to use and enjoy the canal as a navigable waterway. It has negatively impacted access to our bulkhead, the boat ramp, your boat lifts and resulted in lower water quality in the canal and increased flooding of our property. All of which will negatively affect the value of your property as well as mine Adjacent Property. I was not notified by CAMA when the last bulkhead was replaced on the eastern side of the canal. I would not have consented to the further intrusion into the canal had I known. I did, however, go to the CAMA offices in Washington, NC after the last bulkhead replacement and reviewed these issues with CAMA representatives. You may recall I men- tioned these issues to you soon after you purchased your property while in your backyard looking at the repairs necessary to you bulkhead. Permanent Irreparable Damage. I'm sure that there is a work-around that can result in re- placement or repair of your bulkhead without further intrusion into the canal. In the long-term, having a canal that is usable for recreational purposes, with clean water, less flooding and good access to your boat lifts, the boat ramp and my bulkhead will benefit you and the value of your property as well as mine. The damage to your grass by replacing the bulkhead behind your existing bulkhead will be temporary. The grass will regrow. The additional cost, if any, will be minimal when amortized over the life of the replacement. The damage to the navigable waterway by further intrusion into the canal, however, will be permanent. I understand from your drawing that you will make repairs to the bulkhead from the intersection with the Tayloe bulkhead along the river and then along the canal to the intersection with my bulkhead in the boat house section. You are proposing to extend the bulkhead along the canal from the river into the canal by 20 inches to the point of the offset in the current bulkhead and then from there 20 inches inside the existing bulkhead landward to the point of intersection with my bulkhead. My only suggestion is to make the corner where the bulkhead turns towards the boat house a 45° angle rather than the 90 as it is now. While the canal will be narrowed to the point of the offset a 45 would help the river flush the stagnant water from the boat house section of the canal and reduce the toxic algae blooms in the summer. It would give you better access to your boat lift and help me and others make the turn toward my bulkhead without reversing. As I said before, having fresh water in the canal, without toxic algae, that is usable for recreational purposes, with clean water, less flooding and good access to your boat lifts, the boat ramp and my bulkhead will benefit you and the value of your property as well as mine and the public. Kelly.Spivey@NCDENR.gov r SECTION.1100-GENERAL PERMIT FOR CONSTRUCTION OF BULKHEADS AND RIRAP REVETMENTS FOR SHORELINE PROTECTION LN ESTUARINE AND PUBLIC TRUST WATERS AND OCEAN HAZARD AREAS 15A NCAC 07H.1101 PURPOSE A permit under this Section shall allow the construction of bulkheads and riprap revetments for shoreline protection in the public trust waters and estuarine waters AECs according to authority provided in Subchapter 07J.1100 and according to the Rules in this Section. This permit shall not apply to shoreline protection along the oceanfront or to waters and shorelines adjacent to the Ocean Hazard AEC with the exception of those shorelines that feature characteristics of the Estuarine Shoreline AEC. Such features include the presence of wetland vegetation, lower wave energy and lower erosion rates than the adjoining Ocean Erodible Area. The applicant shall provide information on site location, dimensions of the project area,and the applicant's name and address. (b) The applicant shall provide: (1) confirmation that a written statement has been obtained signed by the adjacent riparian property owners indicating that they have no objections to the proposed work;or (2) confirmation that the adjacent riparian property owners have been notified by certified mail of the proposed work. The notice shall instruct adjacent property owners to provide written comments on the proposed development to the Division of Coastal Management within 10 days of receipt of the notice, and, indicate that no response shall be interpreted as no objection. The Division of Coastal Management shall review all comments and determine, based on their relevance to the potential impacts of the proposed project, if the proposed project can be approved by a General Permit. If the Division of Coastal Management determines that the project exceeds the guidelines established by the General Permit Process, DCM shall notify the applicant that an application for a major development permit shall be required. (c) No work shall begin until an on-site meeting is held with the applicant and a Division of Coastal Management representative so that the proposed alignment may be marked. Written authorization to proceed with the proposed development shall be issued if the Division representative finds that the application meets all the requirements of this Subchapter. Construction of the bulkhead or riprap revetment shall be completed within 120 days of the issuance of the general authorization or the authorization shall expire and it shall be necessary to re-examine the alignment to determine if the general authorization may be reissued. The applicant shall pay a permit fee of four hundred dollars ($400.00) for bulkheads. Permit fees shall be paid by check or money order payable to the Department. (c) There shall be no interference with the use of the waters by the public by the existence of the bulkhead or the riprap revetment authorized herein. Bulkheads and riprap revetments authorized in this Rule shall not interfere with the established or traditional rights of navigation of the waters by the public. 47 (d) This permit shall not be applicable to proposed construction where the Division of Coastal Management has determined,based on an initial review of the application,that notice and review pursuant to G.S. 113A-119 is necessary because there are unresolved questions concerning the proposed activity's impact on adjoining properties or on water quality;air quality;coastal wetlands;cultural or historic sites;wildlife;fisheries resources;or public trust rights. (e) This permit shall not eliminate the need to obtain any other required state,local,or federal authorization. (f) Development carried out under this permit shall be consistent with all local requirements,AEC rules,and local land • • use plans current at the time of authorization. The bulkhead position shall not exceed a distance of five feet waterward of normal high water or normal water level at any point along its alignment. (2) New bulkheads or riprap revetments on shorelines within manmade upland basins,canals,and ditches, shall be positioned so as not to exceed an average distance of two feet and maximum distance of five feet waterward of normal high water or normal water level. (3) When replacing an existing bulkhead, the new alignment shall be positioned so as not to exceed a maximum distance of two feet waterward of the current bulkhead alignment. To tie into a like structure on the adjacent property,replacement bulkhead position shall not exceed a maximum distance of five feet waterward of the current bulkhead alignment. When replacing a bulkhead where lands landward of the bulkhead were lost in the last year,bulkheads shall be positioned a maximum of two feet waterward of the original/existing alignment. (4) Riprap revetments shall be positioned so as not to exceed a maximum distance of 10 feet waterward of the normal high water or normal water level at any point along its alignment. (b) Along shorelines with wetland vegetation, bulkheads and riprap revetments shall be positioned so that all construction is to be accomplished ands_ f such vegetation. (c) Bulkheads shall be constructed of vinyl, or steel sheet pile, concrete, stone, timber, or other suitable materials approved by the Division of Coastal Management. (d) Riprap revetments shall be constructed of granite,marl, concrete without exposed rebar,or other suitable materials approved by the Division of Coastal Management. (e) Reyetment material shall be free from loose dirt or other pollutants. (f) Revetment material shall be of sufficient size to prevent movement from the site by wave action or currents. (g) Construction design for riprap revetments shall take into consideration the height of the area to be protected (i.e. bulkhead height, escarpment height, water depth) and the alignment shall allow for a slope no flatter than three feet horizontal per one foot vertical and no steeper than 1 Y2 feet horizontal per one foot vertical. (h) All backfill material shall be obtained from an upland source pursuant to 15A NCAC 07H.0208. The bulkhead or riprap revetment shall be constructed prior to any backfilling activities and shall be structurally tight so as to prevent seepage of backfill materials through the structure. 1 (i) No excavation, grading or fill shall be permitted except for that which may be required for the construction of the bulkhead or riprap revetment. This permit shall not authorize any excavation waterward of the approved alignment. (j) Runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do no enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence,etc.). (k) If one contiguous acre or more of property is to be excavated or filled, an erosion and sedimentation control plan shall be filed with the Division of Energy, Mineral, and Land Resources, or appropriate local government having jurisdiction. This plan shall be approved prior to commencing the land-disturbing activity. (1) For the purposes of these Rules,the Atlantic Intracoastal Waterway(AIWW)is considered a natural shoreline. (m) Construction authorized by this general permit shall be limited to a maximum shoreline length of 500 feet. REGAN Secretary Coastal Management BRAXTON DAVIS ENVIRONMENTAL.QUALITY Director BUFFER AUTHORIZATION CERTIFICATE FOR SHORELINE STABILIZATION A riparian buffer authorization is required for shoreline stabilization activities within the Neuse and Tar-Pamlico River basins per Division of Water Resources(DWR) regulations 15A NCAC 02B.0233 and 0259. The Division of Coastal Management(DCM)through a Memorandum of Understanding with the Division of Water Resources(DWR) has reviewed your project proposal and has determined that the project as proposed complies with the aforementioned regulations. Those activities covered by your Coastal Area Management Act(CAMA)permit have received Buffer Authorization provided the project is constructed in a manner that continues to meet all of the conditions listed below. Failure to • comply with this Buffer Authorization may subject the property owner and the party(contractor) performing the construction and/or land clearing to a civil penalty by DWR of up to$25,000 per day per violation. 1. Impacts: Impacts to woody vegetation from clearing and filling in Zone 1(begins at the most landward of either normal water line(NWL)or normal high water line(NHWL)and extends 30 feet landward)shall be minimized to what must be impacted for the sound installation of the shoreline stabilization project. Unnecessary clearing and • filling in the buffer is a violation of the riparian buffer rules. 2. Clearing& Grading:Clearing and grading of Zone 2 (begins at the landward edge of Zone 1 and extends 20 feet landward) is allowed provided that it is re-vegetated immediately and Zone 1 is not compromised,which includes maintaining diffused (non-channelized)flow of storm water runoff through the buffer. 3. Construction Corridors:Construction corridors are allowed for shoreline stabilization projects, but they must be satisfactorily restored as described in condition 5 below. 4. Potential Overwash: For vertical shoreline stabilization projects (bulkheads)only;sites where wave overwash is expected to be severe,the first ten (10)feet landward (unless specifically authorized otherwise by DCM)from the structure may be maintained as a stable lawn in order to provide for structural stability. s. Temporary Stabilization: Immediately post-construction, bare soils must be stabilized as quickly as possible by providing a temporary ground cover. Newly seeded areas should be protected with mulch and/or erosion matting. This ground cover is a temporary measure used to address erosion until site restoration can be accomplished. 6. Site Restoration:At minimum,pre-project site conditions must be re-established.A site that was wooded prior to this shoreline stabilization project must be restored with woody vegetation at a stem density of 260 stems per acre. Non wooded sites may be re-vegetated with woody vegetation.
