Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that I)prior to undertaking any activities authorized by this permit,the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief,certify that this project is consistent with the North Carolina Coastal Management Program.

This letter is in response to your August 27, 2002 correspondence and subsequent voice mail on
September 3, 2002, with respect to your concerns about the proposal by Mr. Tim Chase to construct a
bulkhead on his lot, adjacent to your property, at 7181 Carolina Beach Road, in New Hanover County. The
proposed bulkhead includes a wing wall up the southern property line to retain fill material that will be
imported to the lot in preparation for residential construction. Unlike piers and docks, bulkheads are not
subject to the 15 ft. setback requirement from adjacent property lines, therefore, no waiver is required from
you. The proposed project has been determined to comply with the Rules of the Coastal Resources
Commission (7H.1100), and as such, the Division has issued a CAMA General Permit for the proposed
action. I have enclosed a copy of the rules which govern the issuance of permits for bulkheads and the
placement of rip rap (rock).

If you wish to contest our decision to issue this permit, you must file for a contested case hearing
within twenty (20) days from the date the permit was issued. I have enclosed the applicable forms and
