On July 2, 2000, we renewed general permit No. 197800056, (copy enclosed), that authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and boat shelters, mooring piles, dolphins,jetties and breakwater structures in navigable waters of the United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act of 1899. Your work is authorized provided it is accomplished in strict accordance with your submitted plans, the enclosed general conditions, and the following special conditions: 1. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. 2. An as built survey of the structure will be performed at the completion of the project and sent to our office for review for navigation concerns. Your proposed work is authorized if you can comply with all permit conditions. Please read the enclosed permit to prevent an unintentional violation of Federal law. In October, Tom Morgan and I met with Howard Varnam and you to discuss the permit. At the time, Mr. Varnam said he would have no problem with the dock proposal, but the Corps of Engineers setback requirement would need to be waived. At the time you said we would have to apply for a Major CAMA Permit. Since that meeting,Tom Morgan spoke with Bob Stroud with CAMA and Mr. Stroud stated that all he would need to issue a general permit is a letter from the Corps of Engineers waiving the setback requirement. You then said that I should fill out an application and send it to your office for review. The proposed pier will be a maximum of six feet in width and extending from the landward edge of marsh to the waterward edge of marsh and then turning and running parallel with the marsh line for thirty feet. There will also be a floating dock six feet by 24 feet adjacent to and running parallel with the waterward edge of marsh. The floating dock will be located on the waterward side of the marsh and a minimum of ten feet from the toe of the Lockwood Folly River dredge channel. Also, the support pilings for the floating dock will be located on the marsh edge of the dock. The floating dock will have to be removed at the owners expense during dredging projects if requested by the U.S. Army Corps of Engineers.
