Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that I)prior to undertaking any activities authorized by this permit,the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief,certify that this project is consistent with the North Carolina Coastal Management Program.

Pier/Dock Restoration
Dear Mr. Smith:
This letter is written in follow-up to our on-site meeting of September 12, 2002. At that time it was noted that you
had removed the second level deck and stairs from your pier/dock structure. You had also removed decking, but
not support pilings or floor joists underneath. At the meeting, you indicated that Jerry Parker had approved of this
correction (removing decking only). It has been my experience that if the support pilings and floor joists remain,
eventually the decking will go back down, even if it's a new property owner that does it. Therefore, I would like •
you to remove the floor joists and take out those pilings. Keep in mind that no portion of decking is to be more than
6' (in any direction). It will be o.k. with me to finish making this adjustment when the marine contractor comes back
to do other work. You mentioned that you are interested in getting a permit for a boat lift at your dock. As a
reminder, I would like to see the riparian corridor delineated, in the field, by a surveyor, prior to issuing any other
permits.

Dear Mr. Smith:
- This letter is in reference to the Notice of Violation that Jerry Parker, representative for the Division
of Coastal Management, sent to you on November 26, 2001, for construction of a pier that was 287 feet too
long with a floating dock at the waterward end and a 11' x 10' dock located approximately 187 feet from the
bulkhead after permit expiration at 454 Womble Street, Oak Island, Brunswick County. The violation
involved Public Trust, Estuarine Waters, Estuarine Shoreline and Coastal Wetlands, which are Areas of
Environmental Concern designated by the Coastal Resources Commission. All restoration requested by the
Division of Coastal Management has been completed.
The Coastal Area Management Act provides that a civil assessment of up to $2500.00 may be
assessed for any violation. It is the policy of the Coastal Resources Commission to assess a civil penalty for
all violations. This is done to recover some of the costs of investigating violations and/or to compensate the
public for any damage to its natural resources.
Under the rules of the Coastal Resource Commission, a civil penalty in the amount of$350.00 is
appropriate for this violation. Therefore,I am informally proposing a$350.00 penalty against you. You may
expeditiously resolve this matter at this time by accepting responsibility for the violation, waiving your right to
an administrative hearing, and paying the amount proposed above. In order to do this, you must: (1) sign
one of the attached copies of a "Waiver of Right to an Administrative Hearing and Agreement to Pay Civil
Assessment", (2) attach a check or money order for $350.00 made payable to the North Carolina
' Department of Environment and Natural Resources (NC DENR); and, (3) return the signed waiver and
payment to this office in the enclosed, self-addressed envelope within ten (10) days of your receipt of this
letter. I will deposit your check in the Department's account and issue you a Notice of Compliance officially
closing this enforcement action.

AND AGREEMENT TO PAY PROPOSED CIVIL ASSESSMENT
I understand that the staff of the Department of Environment and Natural Resources will propose the
assessment of a civil penalty in the amount of$350.00 against me for violation of the Coastal Area Management Act,
NCGS 113A-100 et seq.committed on or near my property in Brunswick County,North Carolina. I also understand
that I have a right under G.S. 113A-126(d)(3) and 150B-23 to a quasi-judicial administrative hear on the alleged
violation and proposed civil penalty.
In order to resolve this matter with no further action or expense on my part,I accept responsibility for the
violation as described in the Notice of Violation letter dated November 26,2001,voluntarily waive my legal right
to an administrative hearing,and agree to pay the civil assessment of$350.00. I understand that in doing so,I also
