Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that I)prior to undertaking any activities authorized by this permit,the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief,certify that this project is consistent with the North Carolina Coastal Management Program.

Dear Ms. Russell:
The description provided for the location of the proposed bulkhead is not entirely clear. Is the
bulkhead to be constructed on the revised or current Atlantic Intracoastai Waterway line?
I have no objection to the building of a bulkhead if it is a continuation of the one 1 have
constructed at 121 South Shore Drive on the current Atlantic Intracoastal Waterway line. In
fact, I would welcome it.
If, however, it is to be built on the revised Atlantic Intracoastal Waterway right-of-way line, I
am concerned that there will be a significant storm water runoff problem for me. The Town of
Holden Beach lowered the Halstead Street right-of-way at South Shore Drive several years
ago. During heavy rain, runoff from the entire area collects there and creates a "gully wash".
A bulkhead erected on the revised Atlantic Intracoastal Waterway line would most likely
cause runoff water to be backed up and diverted to my property. There has been a substantial
wash out of dirt on the landward side of my bulkhead previously. The Town rectified the
problem for me recently by contouring the slope of the Halstead Street right-of-way,
centering the storm water runoff.
I would have no objection to the construction of a bulkhead on the revised Atlantic
Intracoastal Waterway line if the Town of Holden Beach and the Division of Coastal
Management can both assure me in writing that there will be no storm water runoff issues for
my property.
