SUBJECT: CAMA Major Permit Application Consistency Determination: Oyster Harbour Waterway
Park—Brunswick County
DATE: October 16,2002
The applicant is proposing to construct a water-based amenity park to serve the residents of Oyster
Harbour subdivision. The following site amenities are proposed: (1)nine-slip community pier and
docking facility,including finger piers and mooring pilings; (2)open deck; (3) gazebo; (4)parking lot; (5)
mulch playground; (6)covered pavilion; (7) 65 foot long bulkhead;and, (8)boat ramp with associated
extension(12 feet wide X 215 feet in length).
Oyster Harbour subdivision is located at the end of Boones Neck Road in the unincorporated portion of
Brunswick County. Oyster Harbour subdivision is located on the mainland side of the Atlantic Intracoastal
Waterway(AIWW)across from Holden Beach. The subdivision borders the Shallotte River to the west,
Windy Point Road to the south, and Boones Neck Road to the east. According to the Division's Field
Investigation Report,the following Areas of Environmental Concern(AECs)will be impacted: Public
Trust Area,Estuarine Waters,Estuarine Shorelines and Coastal Wetlands. Waters at the site are classified
SA, and are open to shellfishing. Although waters at the site are not designated as Primary Nursery Area
(PNA), a PNA is located less than one mile to west near the mouth of the Shallotte River.
This development proposal has been reviewed for consistency with the Brunswick County Land Use Plan
(LUP) 1997 Update. The land classification for the subdivision is Transition—Area of Town&Village
Clusters. The purpose of this classification is to provide for future development on suitable lands where
urban services will be provided. The Conservation land classification applies to the previously mentioned
AECs. The purpose of the Conservation land classification is to provide for the effective,long-term.
management and protection of significant, limited or irreplaceable areas. The following LUP policies are
applicable to AECs:
LUP Policy 8.1.2.0—Areas of Environmental Concern—the county will support and enforce, through
its local CAMA permitting capacity, the State policies and permitted uses in AECs. Such uses shall be
in accordance with the general use standards for coastal wetlands, estuarine waters and public trust
area AECs as stated in 15A NCAC 7H.
LUP Policy 8.1.2(a)—Coastal Wetland AECs—preservation of coastal wetlands shall be balanced with
the economic and community values of publicly and privately-owned piers, docks and marinas.
LUP Policy 8.1.2(b)—Estuarine Waters AECs—developments that support and enhance the natural
function, cleanliness,salinity and circulation of estuarine water resources shall be supported.
LUP Policy 8.1.2(c)-Public Trust Area AECs—the need for private piers is to be balanced with the
public's right to use Public Trust waters for navigation,shellfishing and other uses. Furthermore, the

County supports efforts of State and Federal agencies that the limit the length of docks and piers as
they project into estuarine waters.
LUP Policy 8.1.2(d)—Estuarine Shoreline AECs—the County supports protection and preservation of
estuarine shorelines in accordance with CAMA use standards.
LUP Policy 8.1.4(a)—Freshwater Swamps,Marshes,Pocosins and 404 Wetlands—the County will
continue to support protection and preservation of freshwater swamp and marsh areas through the
CAMA and 404 wetlands permitting programs.
The table below contains a summary of proposed activities, applicable LUP policies and consistency with
the referenced LUP policies.

Based on the Anticipated Impacts section of the DCM Field Investigation Report,the following LUP
policies are generally applicable to this project:
LUP Policy 8.1.4(f)—Cultural and Historic Resources—the County encourages efforts to protect cultural
and historic resources to preserve their cultural, educational and aesthetic values and qualities.
LUP Policy 8.1.7(b)—Stormwater Runoff—the County shall support a program of vegetated buffers
adjacent to all streams,rivers,marshes and estuarine waters in the county,with the intent of reducing the
flow of nutrients and other contaminants into area surface waters.
LUP Policy 8.1.14—Water Quality Problems and Management Measures—the County supports State and
Federal standards in order to prevent or minimize adverse water quality impacts. The County shall work
with the State on measures to reduce stormwater runoff rates,soil erosion and sedimentation,and point
source discharges into area waters (cross reference Policy Section 8.1.7)
LUP Policy 8.2.4—Commercial and Recreational Fisheries—the County supports efforts to maintain and
enhance the fisheries resource of its waters,including water quality protection measures,nursery and
habitat preservation,proper fisheries management and enforcement, and aquaculture development and
artificial reef activities.
LUP Policy 8.3.11(b)—Beach,Waterfront and Boating Access—The provision of boating access facilities
by the County, State,Towns and private interests shall be encouraged and supported as an important
means of public access to area waters.
The proposed boat ramp extension will result in the filling of approximately 1,740 square feet of coastal
marsh (DCM Field Investigation Report). According to the DCM Field Representative, this proposed
filling is inconsistent with 1 SA NCAC 7H.0205& 7H.0208. As such, the proposed boat ramp extension
appears to be inconsistent with LUP Policy 8.1.2.0. which states, 'the County supports State policies
and permitted uses in AECs in accordance with the general use standards for coastal wetlands AECs as •
stated in 1 SA NCAC 7H.' All other proposed project activities and site amenities appear to be
consistent with the referenced LUP policies provided all local, state and federal regulations are met

Assessment(EA) for Bald Head Creek Shoal Dredging and Groin Construction
Project—Village of Bald Head Island, Brunswick County

The Village of Bald Head Island is proposing to dredge approximately 190,000 square feet of
sand shoals and intertidal sand flats at the mouth ofBald Head Creek. This proposed project
would be conducted as a navigational improvement project. Approximately 40,000 cubic yards
of dredge spoil material will be deposited on the southwest side of Bald Head Creek. In addition
to navigational dredging,the Village is proposing to construct a wooden or rip-rap groin
approximately 500 feet in length immediately south of the proposed dredge area. The purpose of
the groin is to prevent future shoaling. According to the EA, dredge spoil material will be
deposited on an adjacent beachfront. It should be noted that this "adjacent beachfront" does not
refer to the Island's ocean beaches, rather the"adjacent beachfront"refers to the area located
immediately south of the proposed groin structure. Alternatively, dredge spoil material might be
deposited within the existing groin field located between the project area and the Bald Head
Island marina(Updated Environmental Assessment,August, 2002).
The following Areas of Environmental Concern(AECs)will be impacted: Public Trust Area,
Estuarine Waters and Estuarine Shorelines. Waters of Bald Head Creek are classified SA-High
Quality Waters (HQW) and are closed to shellfishing. Waters of the Cape Fear River are
classified SA and are open to shellfishing. Neither the waters of Bald Head Creek or the Cape
Fear River are designated as a Primary Nursery Area(PNA).
This development proposal has been reviewed for consistency with the Brunswick County Land
Use Plan(LUP) 1997 Update. The Brunswick County LUP contains policies specifically
applicable to the Village of Bald Head Island(BHJ). The land classification for this site is
Conservation. This Conservation land classification applies to AECs. The,purpose of this
classification is to provide for effective long-term management and protection of significant
natural areas. The following LUP policies are applicable:
LUP Policy 8.1.2.0—Areas of Environmental Concern—the County will support and enforce,
through its local CAMA permitting capacity, the State policies and permitted uses in AECs.

Such uses shall be in accordance with the general uses standards for estuarine waters,public
trust areas and ocean hazard areas as stated 15A NCAC 7H.
LUP Policy 8.1.2(b) —Estuarine Water AECs—Developments and mitigation activities which
support and enhance the natural function, cleanliness, salinity and circulation of estuarine
water resources shall be supported.
LUP Policy 8.1.2(d)—Estuarine Shoreline AECs—the County supports protection and
preservation of it estuarine shorelines through the application of LAMA use standards.
LUP Policy 8.1.4(d)-Shellfishing Waters—the County supports and encourages the activities
of the State's Shellfish Management program.
LUP Policy 8.1.14— Water Quality Problems and Management Measures—the County
supports State and Federal standards which seek to prevent or minimize adverse water quality
impacts.
LUP Policy 8.3.8(a)—Assistance to Channel Maintenance and Beach Nourishment—the
County supports continued maintenance of navigable channels and inlets.
LUP Policy BHI 8.6.1-c states, the Village of Bald Head Island supports state and federal laws
designed to.manage development in Estuarine Shoreline AECs.
There do not appear to be any policies contained in the LUP that would specifically preclude
either the proposed navigational dredging of Bald Head Creek or construction of a groin
structure. However, the LUP policies—specifically LUP Policy 8.1.2.0, which supports the use
standards contained in the 15A NCAC 7H rules—require that the project be consistent with 15A
NCAC 7H in order to be consistent with the LUP.
