(910) 270-2778 February 19, 2002 Mr. Jerry Parker Division of Coastal Management 127 Cardinal Drive, Extension Wilmington, NC 28405 Dear Mr. Parker We are writing you because we have been informed that DCM is being approached for permission to install one or more boats lifts at the Avila Yacht Basin. For the record, we certify that we own property adjacent to Avila. We wish to express our strong opposition, on the following grounds: 1. Non-compliance with local regulations for the Protection of the environment (CAMA G.S. 113A-120 (b l) (4). Two years ago, to settle a Superior Court lawsuit against the County, Avila agreed to post the following signs: (1) "NO PROP DREDGING ALLOWED" (2) "NO LITTERING - $1000 FINE" (3) the "universal symbol" prohibiting the dumping of head/waste waters. And (4)Avila also agreed to provide a copy of these regulations to every person to whom a boat slip was sold, leased or assigned. No signs were posted. A year ago, Pender County Incorporated the above signage provisions and notification into the Special Use Permit that Avila had been issued to build its floating dock extension. We were told at the time by the County that if Avila failed to honor its agreement, the entire Special Use Permit could be revoked. Still, no signs were posted. Ironically, LAMA G.S. 113A-120(b2) goes on to say that an applicant's record may be considered for only two years prior to the application date. In other words, though Avila may comply once DCM points out the problem, that will not change their two-year record of non-compliance. 2. In the case of coastal wetlands. that the development would contravene an order that has been issued pursuant to G.S. 113-230 (LAMA G.S. 113A-120(a) (1). Because the water at low tide in the Avila Yacht Basin is so shallow - between 5" and 13" as va- Jerry Parker -2- February 21, 2002 determined by a DENR survey conducted by Janet Russell -we believe that boat lifts will make dredging inevitable. Boat lifts require a minimum amount of water to function. In less than 17" of water, a lift cannot remove a 23-foot long boat from the water at all. If boat lifts are installed, it seems to us that we will be presented with two choices, both unacceptable:either we shall have to rely upon the slip owners to use their boats/lifts only at peak high tide(?!), or we shall have to continue to serve as unpaid CAMA policemen, eyes glued to binoculars and tide tables, hands poised to telephone your understaffed department. Under these circumstances, dredging is predictable:And since the Avila slips have been built within a few yards of a shellfish pond and adjacent Primary Nursery Area, the effect of any dredging would be disastrous and according to DCM and Pender County, prohibited.During a hearing two years ago before the Pender County Commissioners, Dr.Pete Peterson of the UNC Institute of Marine Science spoke eloquently on the threat that dredging poses for Primary Nursery Areas. If you like,we can provide you with a record of his remarks. Equally disastrous, of course,would be any leaks of fuel or sewage from boats dangling precariously over waters continually swept by the wakes of Waterway traffic.All the slips are unprotected, open to waves which routinely toss the floating docks like toys. 3.The development is inconsistent with the State auldelines or local land use plans (CAMA G.S. 113A-120(a)(8). Pender County's development guidelines prohibit projects that will have an adverse effect on adjacent property values.We are prepared to provide expert opinions from real estate professionals that a view of a mini- dry dock, not to mention the noise therefrom,will adversely impact adjacent property values. 4. Incomplete, misleadina and inaccurate information. Mr.Conway's letter requesting a waiver of our rights stated he was including plans for the proposed boat lifts for our consideration. No such plans were included. Instead, he sent us a copy of a "proposed"design for the Avila Pier addition, dated 1997.This drawing is so Inaccurate that it served as evidence in the above mentioned hearing before the Pender County Commissioners accusing Avila of fraud in their Special Use Permit application. Mr. Conway further directed us to return the completed Waiver Form to him rather than to DCM. (Waiver Form enclosed ) Our concerns are based on four years of disrespect and disregard for truthfulness, neighbor's rights and the environment. Based on all of the above,we believe that adding boat lifts will provide a continuing source of problems for the environment, DCM and the adjacent property owners. It clearly illustrates our concern regarding the dangerously shallow water and very real threat of dredging at the Avila Yacht Basin. Before DENR considers issuing a permit for boat lifts at Avila, it would seem prudent to measure the depth of the water between the channel and the slips, to determine whether it's even possible to move a boat in and out without dredging. At approximately 2 pm on March 3rd, we sited a sailboat (approximately 26' long, sails furled ), drifting in the Intracoastal Waterway. It seemed to have lost engine power and was attempting to maneuver over to the Avila floating dock using the strong wind and current to propel the boat. As it came within about 10 feet of the outer pilings of the south end, it ran aground, as shown in the photo marked 2:15 pm. At first, the 2 man crew attempted to free the boat, but the tide was heading out. The second photo shows the sailboat totally `beached' 3 hours later, at 5:15 pm. According to the 2001-2002 Tide Table distributed by the Topsail Island Fishing Club, low tide at New Topsail Inlet was at 5:35 pm. Low tide within the waterway occurs about 1 1/2 hours later. That would put mean low tide at the Avila dock at 7:05 pm on March 3rd, nearly 5 hours after the sailboat drifted aground. The following morning the sailboat was floating at the edge of the channel, tied up to Marker # 96. Mean high tide had been at about 1:05 am. We could now see the stern and noted the name, "Mischief" out of Norfolk. At 10:15 am, on March 4th, we noted a red power boat with the logo "Tow Boat U.S." tied up beside the "Mischief". Clearly, the crew was still attempting to repair the engine, seemingly with advice from the tow boat operator.At approximately 10:45 am, the "Tow Boat U.S." pulled away and the "Mischief' motored south a few minutes later. There's no question that there is very little water in the Avila slips. It may, in fact, be unnavigable for longer than that . It would seem from these calculations that there is perhaps one hour. twice per day during which one might be able to maneuver in and out of the slips without dredging. In fact, no boat has ever been moored there with the exception of Norma Grabenstein's and that boat had to dredge it's way into the slip ! Thank you for your attention to this matter.
