During that meeting you verbally approved our request to build a roof over a 4' x 8' section of the dock in front of Capt. John's Seafood Restaurant in Calabash, NC. You also approved including lockable cabinets and deployable curtains that would be used in the event of inclement weather. Your approval came on the condition that we submit profile drawings of our proposed structure which we did, via electronic mail, later that same day. The following day, May 14, you contacted me by telephone to inform me that your supervisor declined our request based on the opinion that it was not a water-dependent structure. Via electronic mail on May 14 we formally requested a variance on this decision based on our contention that such a decision places an unnecessary hardship on our business. Our business, sightseeing water cruises, is water-based and our current leasing arrangement allows for a land-based ticketing office approximately 300 yards from the boat. Additionally, this location is difficult for our patrons to find because it is not positioned remotely near the the natural flow of traffic to the boat. Per section 113A- 120.1. of the Coastal Area Management Act, we feel our situation fits the guidelines set forth for granting variances: • The only land location available to us places a practical difficulty on the business; ' 1. The owners,fearing that a convenient land-based office would disrupt the view of the restaurant, will only allow an office on the opposite side of the property from the boat location; • The Commission could not have foreseen nor predicted the whims of the restaurant ownership. Furthermore, as you stated in our initial meeting, what we propose is well within the CAMA guidelines. We are appealing to the Commission's logic that a water-based business would be best served by a dockside office and especially if a practical land- based option were not available, which is the case here. We appreciate your willingness to work with us towards something that is mutually acceptable. Per your request, please find attached a profile drawing of our proposed structure (Diagram 1) . As we discussed, it will be an open-air structure consisting of a counter with lockable cabinets and a roof. Specifically, it will measure 41 across the front and be 81 deep. The countertop will be 41 from the floor with a total booth height of 81. The counter would extend across the front and along one side. We would use the dock surface as the floor with the intention that should this structure need to be removed, it may be done so with minimal consequences. The dock runs the length of the Capt. John's Seafood Restaurant lot and we would like to place it, when facing the water from shore, on the right end (Diagram 2) . The walkway from shore terminates in an open area of dockspace measuring approximately 25'x30' . We would like to position our structure at the termination point of the walkway. As we mentioned in our conversation, we have a significant investment in our ticketing system and the lockable cabinets will protect them while we are not present. There may be times when weather conditions may threaten this equipment (wind, rain) , and we would like to install deployable, weatherproof curtains.
