Dear Mr. Beam:
I am in receipt of your note of objection regarding the Town of Oak Island's request to build or rebuild the beach
access walkover at the above-referenced address. You were notified as a courtesy not as a requirement of the
Division or the law. The beach walkover construction is exempted from requiring a permit and I have enclosed a
copy of the conditions that apply and a copy of the Exemption authorization. •
When a permit is required, there is an appeal process for those individuals that wish to present a case for permit
denial. However, since no permit is required for the beach walkovers, I do not know if there is an appeal process.
I have left a message with our attorney in the Attorney General's Office (Ms. Merri Jo Alcoke) to get an opinion on
this. If you feel that you would like to follow through with an appeal (provided it is legal to do so)please notify me

In 1974,the North Carolina General Assembly passed
