This permit is subject to compliance with this application, site
drawing and attached general and specific conditions, Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
Thais permit must be on the project site and accessible to the
permit officer when, the project is 'inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.
In issuing this permit the State of North Carolina certifies that
this project is consistent with the North Carolina Coastal
Management Program.

General statute 11 -29 requires that riparian landowners
with property adjoining a proposed excavation and/or fill project
be given thirty (30) days in which to comment on the project.
This form allows the adjacent riparian landowner to express
either: (1) That he objects to the project; or, (2) That he does
not object and desires to waive his right to the 30-day period so
that the processing of the application can progress more rapidly.

Dear Ms. McClellan:
Through coordination with Mr. Robert Abernethy of the North Caroliaa
Division of Coastal Management, we have learned of your plans to construct a
bulkhead on a manmade canal, Brigands Bay, Blackbeards Court, Dare County,
North Carolina.
On January 1, 1987, we renewed general permit No. SKWC082-N-000-0277
(enclosed) that authorizes excavation and filling; construction of piers,
docks, bulkheads, and boat ramps; placement of riprap and mooring pilings
within manmade basins, canals, or ditches located entirely on high ground; and
maintenance dredging of canals, channels, basins, and ditches in open waters
or marsh areas (with high ground disposal) in North Carolina.
Your proposed work is authorized if you can comply with all permit
conditions and the bulkhead alignment indicated by Mr. Abernethy on May 27,
1988. Please read the enclosed permit to prevent an unintentional violation
of Federal law. As this Department of the Army general permit does not
relieve you of the responsibility to obtain any other required approvals, You
should contact appropriate State and local agencies before beginning work.
