This lot is located on a true river scarp embankment of New River and most of the jurisdiction of the waters of the US and NC are defined by the ordinary water mark of the New River. The only 2 small areas where section 404 wetland defines the. waters of the US jurisdiction were delineated and enumerated Al through A5 and B1 through B6. The approximate locations and extent are shown on the attached sketch map. Since most of your questions were resolved by Jim Gregson, I offer only the following abbreviated conclusions. All of the 404 wetlands are at or closer to the river than the present CAMA stakes. Since no wetland encroachment is proposed, a wetland permit is not required. Since no wetland permit is now desired, a full determination form will not be prepared. The area does of course lie within a CAMA AEC and a CAMA permit is required. If any encroachment into 404 wetlands becomes required or desired, substantial delays are possible since the CAMA permit would then be placed in the Major Permit category. If at all reasonably possible, I advise avoiding any encroachment into those delineated wetlands. It may also be to your benefit to document the location of the delineation to assure proof of no encroachment though the present documentation on the CAMA stakes may be sufficient.
