applicant certifies by signing this permit that I)prior to undertaking any activities authorized by this permit,the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s).

MINOR DEVELOPMENT
PERMIT
as authorized by the State of North Carolina,Department of Environment,
Health,and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statues,"Coastal Area Management"
Issued to Mr. Billy Ray Scott and Ms. Georgette Myers,authorizing the construction of a 6'wide x 30' long elevated walkway
in the ORW shoreline AEC at 8210 River Road, as requested in the permittee's application dated December 5, 2002. This
permit, issued on December 20, 2002, is subject to compliance with the application and site drawing(where consistent with
the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may
subject permittee to a fine, imprisonment or civil action;or may cause the permit to be null and void.
• A copy of this permit shall be available onsite for regulatory inspection.
• An undisturbed buffer zone of a least thirty feet from the mean high water(normal water line)
must be maintained at all times.
• All proposed development and associated construction must be done in accordance with the
permitted workplat drawings as submitted and amended.
• All construction must conform to the N.C. Building Code requirements and all other local, State
and Federal regulations.
• Any change or changes in the plans for development, construction or land use activities will
require a re-evaluation and modification of this permit.
• The amount of built-upon area shall be limited to no more than 25%of the 575'Area of
Environmental Concern area of the land to be developed; in this case,there is no increase in
impervious coverage.
• No filling or development within any Federally regulated 404 wetlands is authorized.
• No sediment or building materials can be allowed to enter the marsh grasses or waters. Silt fence
or other protective barriers(s)must be placed and maintained between the disturbed area and any
404 wetlands or coastal wetlands,to keep sediment from entering those areas.
This permit action may be appealed by the permittee or other n c
qualified persons within twenty(20)days of the issuing date. FromGIL

Activity: Construct Pier
1. Project Location: 8210 River Road Wilmington, NC (New Hanover County)
2. Purpose: The purpose of this project is to construct a private pier (with boat
slip and lift) on the Cape Fear River.
3. Project Description:
This proposal is presented graphically in the attached site plan and Drawings. The
proposed project will use a local contractor experienced with pier construction.
New Hanover/North Carolina Building Code and COE requirements will be met or
exceeded.
Pier - Construct a pier, in a westerly direction, from the western property line of
the Scott/Myers tract to a point in the Cape Fear River equal to the 3ft water level
during Mean Low Tide (not to exceed the maximum length allowed by the Corps
District Office or the existing line established by adjoining property owners pier
(approximately 130 ft)). The pier shall be constructed a minimum distance of 55 ft
from the southern adjacent property boundary (Scott) and 69 ft from the northern
adjacent property boundary (Burnett, heirs). The pier deck shall be a minimum of
3 ft above the Mean High Tide water level. The pier will be constructed of treated
pole type pilings (meeting COE and local code) driven or jet washed to a depth of
approx.1 Oft and braced as required. The pier decking will be of 2X6 treated wood
construction (meeting local code) a maximum of 6ft wide with a 12x24 deck on the
end (288 square ft). Additional pilings will be installed, at appropriate intervals,
denoting a 12 X 24 ft boat slip, on the landward side of the 12X24 deck. A
boatlift, capable of accommodating one 25ft boat will be installed. All hardware
will be "hot dipped" galvanized.
