1) In order to protect juvenile shrimp and finfish populations,no excavation will be permitted between ,
April 1, and September 30 of any year without the prior approval of the Division of Coastal ,
Management, in consultation with the Division of Marine Fisheries. ,

• 2) A 10 foot undisturbed buffer shall be maintained between the perimeter of the dredge area and any
area of coastal wetlands. To ensure compliance with this condition, the limits of the proposed
dredge area must be staked by a representative of the Division no more than 30 days prior to the ,
initiation of excavation. Failure to initiate dredging within 30 days will require that the dredge limits ,
be restaked by DCM within a maximum of 30 days prior to the new expected start of construction.

- ADDITIONAL CONDITIONS
3) The depth of the excavation shall not exceed 4 feet in the canal in front of the permittee's properties.
The depth of excavation shall not exceed 6 feet below the elevation of mean low water within the
" connecting channel.
4) The depth of excavation shall not exceed the depth of the connecting waters.
5) No excavated or fill material will be placed, even temporarily, at any time in any vegetated '
wetlands, marsh or surrounding waters outside of the alignment of the fill area indicated on the
workplan drawings.

NOTE: The permittee's contractor is advised to contact the U.S. Coast Guard at [phone],
ext. 108 to discuss operations and appropriate lighting, markers, etc. for all dredge /
equipment. , -
Dredge Spoil Disposal /
/
6) All excavated materials will be confined above mean high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover
of solids into any marsh or surrounding waters. /
7) The exterior slopes of the disposal area dikes shall be at an angle no steeper than 11/2 horizontal -
to 1 vertical. /
8) The bottom of the disposal area will be lined in such a manner so as to prevent effluent water
from percolating into the groundwater table.
/
9) The disposal area effluent will be contained by pipe, trough, or similar device to a point at or '
beyond the mean low water level to prevent gully erosion and unnecessary siltation. '
10) The terminal end of the pipeline will be positioned at o r greater th an_50 feet from any part of the ___
dike and a maximum distance from spillways to allow settlement of suspended sediments.

11) A water control structure or riser pipe will be installed at the intake end of the effluent pipe to
assure compliance with water quality standards. The height of the intake will be maintained so
as to promote settling of sediments prior to discharge.
. 12) The dikes will be properly graded and provided a ground.cover_sufficient to restrain erosion

General
13) This permit does not authorize the interference with any existing or proposed Federal project, and
the permittee shall not be entitled to compensation for damage or injury to the authorized
structure or work which may be caused from existing or future operations undertaken by the
United States in the public interest.
14) -No attempt will be made by the permittee to prevent the free and full use by the public of all /
navigable waters at or adjacent to the authorized work. Use of the permitted activity must not /
interfere with the public's right to free navigation on all navigable waters of the United States.
NOTE: The permittee is encouraged to contact the Pender County Mosquito Control Office at /
[phone] to discuss mosquito control measures. '
