On behalf of 7 Beach Bay Lane LLC, I would like to request a CAMA General Permit for the property
located at 7 Beach Bay Lane, Wilmington, New Hanover County, NC. Please find enclosed permit
drawings (two sheets) and supporting materials. Adjacent riparian landowners have been notified
by certified mail and the return receipts will be provided once they are received, along with a fee
check.
The applicant is requesting to build a fixed pier and dock with a single boat slip. Note that we have
shown the riparian lines based on your November 3, 2020 guidance and in consistency with 15A NCAC
07H .0208 (b) 6 (I). The proposed pier and dock will not interfere with the southern adjacent dock,
there is a minimum of 30 feet between the proposed structure and the adjacent southern structure,
and, considering the location of the southern adjacent dock precludes the ability to draw the riparian
line perpendicular to the nearest deep water, the riparian lines are aligned to meet the intent of the
refenced rule to the maximum extent practicable.

George W. Worth' s Last Will and Testament, filed February

his residuary estate, including the property described below,
to Amanda Parsley Worth, as his executrix, to be distributed
to Amanda Parsley Worth and/or a Residuary Trust established
by his Last Will and Testament; and
The trustee of the Residuary Trust established under
George W. Worth' s Last Will and Testament is George W. Worth,
Jr. and the beneficiaries of the Residuary Trust established
under George W. Worth' s Last Will and Testament are his three

Under ARTICLE IV of George W. Worth' s Last Will and
Testament, the Residuary Trust was to terminate and be
distributed to George W. Worth, Jr. , Amanda Worth Tueting and
Margaret Worth Myers upon the death of Amanda Parsley Worth or
upon the first date that there shall be no living child of
George W. Worth who shall not have attained thirty-five (35)

Dear Ms. Elks,
I am the property owner of 5 Beach Bay Lane, Figure Eight Island. I am writing to vigorously object to the
proposed CAMA Permit submitted by Land Management Group on behalf of 7 Beach Bay Lane, LLC,
Wilmington, NC. I also do not waive the 15 foot setback requirements. I do not agree with how the
Riparian lines are drawn as they do not adhere to the Division of Coastal Management
definitive/guidelines (please see letter from my attorney, Mr. Steve Coggins).
My family and I have enjoyed the use of our dock and pier since 1993 when it was permitted by CAMA
and approved by the Figure 8 Homeowners Association. The positioning of the proposed dock for 7 Beach
Bay Lane, LLC is highly intrusive and will negatively impact the quiet enjoyment we have had for about 30
years not to mention the fact that the proposed dock traverses over my property tax parcel delineation
and it terminates in water depth of approximately 1 foot in depth.
The design and placement of the proposed dock is similar to trying to put a square peg in a round hole. I
am very disturbed at what has been proposed and I strongly encourage you and the Division of Coastal
Management to reject it in its entirety.

Dear Ms. Elks:
I represent the owners of 5 Beach Bay Lane West,which is a lot adjacent to 7
Beach Bay Lane West. The owner of 7 Beach Bay Lane West, per CAMA Rules,have
applied for a CAMA General Permit authorizing construction of a pier and have given
required notice("Notice") to my clients. Per the Notice and relevant CAMA Rules,
this letter is a formal adjacent property owner objection to issuance of a permit. Bases
for objection follow. My clients reserve all rights to any bases for objection not stated
herein.
I: The Actual Riparian Corridor Line of Division Is Not Accurately
Shown on the Drawing Submitted With the Notice.
CAMA Rules require that before a permit can be granted, the line of division
(the "Line") demarcating the relevant"15 feet minimum riparian corridor setback"
(the "Corridor")must be located in order to assure that there is sufficient spacing
between adjacent docks. This Line must extend from the point where the common
property line intersects with the Mean High Water line. From there, the Line extends
perpendicular to the channel in front of the property. The relevant CAMA Rules
state:

(I) Piers and docking facilities shall not interfere with the access to any
riparian property and shall have a minimum setback of 15 feet between any
part of the pier or docking facility and the adjacent property owner's areas of
riparian access. The line of division of areas of riparian access shall be
established by drawing a line along the channel or deep water in front of
the properties, then drawing a line perpendicular to the line of the
channel so that it intersects with the shore at the point the upland
property line meets the water's edge....
15A NCAC 07H .1205 SPECIFIC CONDITIONS
(q)Piers and docking facilities shall not interfere with the access to any riparian
property, and shall have a minimum setback of 15 feet between any part of the pier
and docking facility and the adjacent property lines extended into,the water at the
points that they intersect the shoreline. .... The line of division of areas of
riparian access shall be established by drawing a line along the channel or
deep water in front of the property,then drawing a line perpendicular to the
line of the channel so that it intersects with the shore at the point the upland
property line meets the water's edge.Application of this Rule may be aided by
reference to the approved diagram in Paragraph(t) of this Rule illustrating the rule as
applied to various shoreline configurations. Copies of the diagram maybe obtained
from the Division of Coastal Management website at
http://www.nccoastalmanagenient.net. When shoreline configuration is such that a
perpendicular alignment cannot be achieved, the pier or docking facility shall be
aligned to meet the intent of this Rule to the maximum extent practicable.

Thus, to locate the Line, one must first locate the line of the deep water or channel
that is in front of the property. Then, one draws a line perpendicular from that
channel line to the shore at the point the where upland adjacent property lines meet
the water's edge. The Corridor is 15 feet on either side of that Line.
Here, however, the Corridor Line submitted by the applicant does not extend
from the deep water that is in front of 7 Beach Bay Lane West. Rather, the line along
which the proposed pier runs extends from deep water located to the side of the
property, not to its front:

The deep water in front of the property is directly to the west. However, the corridor
line submitted by applicant extends to deep water located to the side of the lot,
extending to the southwest. The proposed line clearly does not comport with the "front
of the property" requirement in the CAMA Rules.
Nor is the submitted line perpendicular (i.e., 90 degrees) to the deep water line.
Rather, the submitted line extends from the deep water line at an angle different from
90 degrees. The proposed line further violates CAMA Rules in this respect.

Accordingly, the application must be denied on the basis that the actual
Corridor and the Line are not, in fact or law, located where they represented in the
materials submitted with the Notice.
II. No Showing Has Been Made That the Required Minimum Water
Depths Have Been Met
The materials submitted with the Notice make no representation about whether
the proposed pier is in a Primary Nursery Area, or whether shellfish beds or
subaquatic vegetation are present in the pier area, or whether the pier is designed to
be a floating pier. Thus, no determination can be made on whether the required
minimum water depths set forth in CAMA Rule 15A NCAC 07H .1205(h) and (i) are
met:
(h) Piers and docking facilities located over shellfish beds or submerged
aquatic vegetation (as defined by the Marine Fisheries Commission)may
be constructed without prior consultation from the Division of Marine
Fisheries or the Wildlife Resources Commission if the following two
conditions are met: (1)Water depth at the docking facility location is
equal to or greater than two feet of water at normal low water level or
normal water level; and (2) The pier and docking facility is located to
minimize the area of submerged aquatic vegetation or shellfish beds
under the structure as determined by the Division of Coastal
Management.
(i) Floating piers and floating docking facilities located in Primary
Nursery Areas, over shellfish beds, or over submerged aquatic vegetation
shall be allowed if the water depth between the bottom of the proposed
structure and the substrate is at least 18 inches at normal low water
level or normal water level.
III. No Showing Has Been Made of Compliance with CAMA Rule Dock
Maximum Dock Lengths
Materials submitted with the Notice show the total length of the proposed pier
is at least 242 feet from normal high water. CAMA Rule 15A NCAC 07H .1205(c)
allows a pier to be longer than 200 feet only if it gives access to deeper water at a rate
of at least one foot at each 100 foot increment of pier length longer than 200 feet.
Thus, the pier can be allowed only if the last 42 feet of the pier gives access to water at
a rate of at least one foot in depth.
However, the drawing submitted with the application does not clearly establish
that the outer 42 feet of the proposed pier gives access to a water depth at a rate of at
least one foot of water. RECEIVED

IV. Formal Notice of No Waiver of Riparian Corridor Rights
Finally, this letter formally gives notice on behalf of my clients that the owners
of 5 Beach Bay Lane West do not waive the 15 feet minimum riparian corridor
requirements in 15A NCAC 07H .0208(b)(6)(I) and 15A NCAC 07H .1205(q) with
respect to the actual location of the Corridor and Line. If it is possible for a legal
Corridor and Line to be established for 7 Beach Bay Lane West, and if the proposed
pier encroaches on the Corridor, then my clients object and do not waive their rights.
The owners of 5 Beach Bay Lane West reserve all rights and any other grounds
of objection to the proposed pier.

Dear Ms. Elks:
We represent'7 Beach Bay Lane, LLC ("7 Beach Bay Lane"), the owner of the real
property at 7 Beach Bay Lane West, Figure 8 Island, Wilmington, North Carolina,
which applied for a CAMA General Permit for a fixed dock and pier with a single boat
slip(the "Project") on December 11, 2020. We have received objections filed on behalf
of the owner of the southern adjacent property at 5 Beach Bay Lane West, Dr. Henry
S. Zaytoun, Jr., by Dr. Zaytoun and his attorney, Stephen D. Coggins (the "Zaytoun
Objections"). This letter will respond.
First, the line of division of areas of riparian access ("Riparian Line") reflected on the
Project plans submitted to the Division and provided with notice to all adjacent
riparian property owners is drawn in accordance with the Division's rules for piers
and docking facilities at 15A NCAC 7H. 0208(b)(6) and .1205 (the "Dock and Pier
Rules"). The Dock and Pier Rules require the Riparian Line to be established by
drawing a line along the channel or deep water in front of the properties, then
drawing a line perpendicular to the line of the channel so it intersects with the shore
at the point the upland property line meets the water's edge (normal high water or
"NHW"). The Dock and Pier Rules also provide that "[w]hen shoreline configuration is
such that a perpendicular alignment cannot be achieved, the pier or docking facility
shall be aligned to meet the intent of this Rule to the maximum extent practicable."
15A NCAC 7H. 0208(b)(6)(I); 15A NCAC 7H .1205(q). The shoreline configuration
surrounding 7 Beach Bay Lane West creates the precise situation this language
addresses.

Our client's consultant, Greg Finch with Land Management Group, communicated
with the Division's Wilmington Regional Office in the fall of 2020 about identifying an
appropriate Riparian Line for 7 Beach Bay Lane West. On November 3, 2020, you
provided to Mr. Finch the following aerial illustration of roughly drawn potential
riparian lines to two areas of deep water acceptable to you and District Manager Tara
McPherson:

The nearest deep water to 7 Beach Bay Lane West is the small bay area to the south
into which several piers, including Dr. Zaytoun's, extends. Accessing the deep water
from this shoreline requires considering the adjacent marsh and the location of the
southern adjacent dock which preclude the ability to draw the Riparian Line
perpendicular to deep water without rendering the location of the existing dock non-
conforming. Following the Division's red parallel lines and the Dock and Pier Rules,
Mr. Finch drew the southern Riparian Line 15 feet away from the existing dock from
deep water to NHW, drew the northern Riparian Line parallel thereto, and located
the proposed fixed dock 30 feet away from Dr. Zaytoun's dock. The Riparian Lines on
the Site Location and Plan View in the application are based on the Division's
guidance; create a corridor that does not interfere with access to the southern
adjacent dock or riparian property; maintain at least 30 feet between the proposed
structure and the adjacent structure; and, are aligned to meet the intent of the
referenced rule to the maximum extent practicable. 15A NCAC 07H .0208 (b)(6)(I)
and .1205(q).

Second, the Project meets the minimum water depths required by the Dock and Pier
Rules. The Project is a fixed dock and pier with a single boat slip in waters at a depth
of-2 feet as reflected in the Plan View Detail submitted to the Division and adjacent
riparian owners. 15A NCAC 7H .1205(g) and (i). Although the surrounding adjacent
marsh contains Primary Nursery Area, the proposed docking facility is outside of that
boundary and does not require dredging. The Project is not located over shellfish
beds nor over an area of submerged aquatic vegetation. 15A NCAC 7H .1205(h).
Third, the Project complies with limits on maximum dock length. The Project may be
issued a General Permit under the Dock and Pier Rules because the pier only extends
45 feet (not including the platform) from the waterward edge of coastal wetlands and
should be exempt from meeting the one foot per 100 feet requirement altogether since
anything less than 200 feet does not need to meet that requirement. Further, the pier
does access deeper water at a rate of at least one foot for each 100 foot increment
longer than 200 feet when measured from the waterward edge of the coastal wetlands
that borders the water body as reflected in the Plan View Detail under 15A NCAC
7H.1205(c). In addition, tax parcel delineation does not determine private property
ownership. Areas waterward of NHW are public trust waters.
Fourth, although reservation of Dr. Zaytoun's riparian corridor rights is not an
objection to our client's application per se, the Project maintains a minimum setback
of 15 feet between the dock and the southern Riparian Line so a corridor of 30 feet
exists between the proposed configuration and Dr. Zaytoun's floating dock. A waiver
of the 15 foot setback is not required for issuance of a General Permit for the Project.

I've removed the northern riparian line and the 'edge of deep water' line and label (attached). It appears that they want
to formalize a slip at this fixed platform. I did not notice it before and I can remove if needed but it looks like the 2'
depth contour runs beside the edge of the platform.
Let me know if this revised drawing(page 2 of the attached) looks how it should and I'll shrink that for the permit.
I can alert LMG to the changes made when I send the finalized version to them for signature.

Christy got back to us on the Beach Bay Permit.
She said "We are putting in the "other" riparian line. Since it's not really at issue, I wonder if we ask them to remove it
from the drawing(I assume LMG provided this?). I think there's a good argument that the other riparian line might be
closer to the area straight out past the marsh. Since it's not relevant here, I don't know that we need to decide it now. "
I think that is a good idea in case things are challenged and it was not necessarily scrutinized during our review.
She also said their labels for"edge of deep water" don't really point to anything. She would also remove those since the
depth contours seem to be enough.
Let me know what you think...

I've drafted the GP for this new dock and since it's had objections and the Figure Eight HOA is involved I'd appreciate a
quick review of the permit before I issue.
I talked with David Kellum the Figure Eight HOA president and he hoped that I would add some language specific to the
dock not meeting their rules. I think that is covered both with the local building permit field and the special conditions.
Let me know if I need to revise anything.

This letter is in response to the Adjacent Riparian Property Owner Statement, which
was received by the N.C. Division of Coastal Management on December 29, 2020,
indicating your possible objections about the proposed development by 7 Beach Bay
Lane, LLC, at property located at 7 Beach Bay Lane West, on Figure Eight Island, NC.
The project consists of constructing a new 274.6' pier, a 16' by 12' fixed platform with a
16' by 4' step down platform, and one boat slip. Based on consistency with the Rule
requirements outlined in 15A NCAC 07H .1200, GENERAL PERMIT FOR
CONSTRUCTION OF PIERS AND DOCKING FACILITIES: IN ESTUARINE AND
PUBLIC TRUST WATERS AND OCEAN HAZARD AREAS, a permit has been issued to
authorize the development. I have enclosed a copy of the permit, as well as the relevant
statutes.
If you wish to contest our decision to issue this permit, you may file a request for a Third
Party Appeal. The Chair of the Coastal Resources Commission will consider each case
and determine whether to grant your request to file for a Contested Case Hearing. The
hearing request must be filed with the Director, Division of Coastal Management, in
writing and must be received within twenty (20) days of the permit decision. The
applicable forms and instructions that must be filed prior to that deadline are available

SECTION.1200—GENERAL PERMIT FOR CONSTRUCTION OF PIERS AND DOCKING FACILITIES: IN
ESTUARINE AND PUBLIC TRUST WATERS AND OCEAN HAZARD AREAS
15A NCAC 07H.1201 PURPOSE
A permit under this Section shall allow the construction of new piers and docking facilities(including pile supported_or
floating) in the estuarine and public trust waters AECs and construction of new piers and docks within coastal wetlands
AECs according to the authority provided in Subchapter 07J .1100 and according to the Rules in this Section. This
permit shall not apply to oceanfront shorelines or to waters and shorelines adjacent to the Ocean Hazard AEC with the
exception of those shorelines that feature characteristics of the Estuarine Shoreline AEC. Such features include the
presence of wetland vegetation,lower wave energy,and lower erosion rates than the adjacent Ocean Erodible Area.

15A NCAC 07H.1202 APPROVAL PROCEDURES
(a) An applicant for a General Permit under this Subchapter shall contact the Division of Coastal Management and
request approval for development. The applicant shall provide information on site location, dimensions of the project
area,and his name and address.
(b) The applicant shall provide:
(I) confirmation that a written statement has been obtained signed by the adjacent riparian property
owners indicating that they have no objections to the proposed work;or
(2) confirmation that the adjacent riparian property owners have been notified by certified mail of the
proposed work. The notice shall instruct adjacent property owners to provide any comments on the
proposed development in writing for consideration by permitting officials to the Division of Coastal
Management within 10 days of receipt of the notice,and,indicate that no response will be interpreted
as no objection. DCM staff shall review all comments and determine,based on their relevance to the
potential impacts of the proposed project,if the proposed project can be approved by a General Permit.
If DCM staff finds that the comments are worthy of more in-depth review,DCM shall notify the
applicant that he must submit an application for a major development permit.
(c) No work shall begin until an on-site meeting is held with the applicant and a Division of Coastal Management
representative to review the proposed development. Written authorization to proceed with the proposed development
shall be issued if the Division representative finds that the application meets all the requirements of this Subchapter.
Construction shall be completed within 120 days of the issuance of the general authorization or the authorization shall
expire and it shall be necessary to re-examine the proposed development to determine if the general authorization may be
reissued.
(d) Any modification or addition to the authorized project shall require prior approval from the Division of Coastal
Management.

15A NCAC 07H.1203 PERMIT FEE
The applicant shall pay a permit fee of two hundred dollars ($200.00) by check or money order payable to the
Department.

15A NCAC 07H.1204 GENERAL CONDITIONS
(a) Piers and docking facilities authorized by the general permit set forth in this Section shall be for the exclusive use of
the land owner, or occupant and shall not be leased, rented, or used for any commercial purpose. Piers and docking
facilities shall provide docking space for no more than two boats. Docking facilities providing docking-space for more
than two boats shall be reviewed through the major permitting process because of their greater potential for adverse
impacts and,therefore,are not authorized by this general permit,excluding the exceptions_described in Rule.1205 of this
Section.
(b)Individuals shall allow representatives of the Department of Environment and Natural Resources to make inspections
at any time deemed necessary in order to be sure that the activity being performed under the authority of the general
permit set forth in this Section is in accordance with the terms and conditions prescribed herein.

(c) There shall be no interference with navigation or use of the waters by the public by the existence of piers and
docking facilities.
(d) The permit set forth in this Section shall not be applicable to proposed construction where the Department
determines that the proposed activity will endanger adjoining properties or significantly.affect historic,cultural,scenic,
conservation or recreation values,identified in G.S. 113A-102 and G.S. 113A-113(b)(4).
(e) The permit set forth in this Section does not eliminate the need to obtain any other required state,local,or federal
authorization.
(f} Development carried out under the permit set forth in this Section shall be consistent with all local requirements,
AEC Guidelines,and local land use plans current at the time of authorization.

15A NCAC 07H.1205 SPECIFIC CONDITIONS
(a) Piers and docking facilities may extend or be located up to a maximum of 400 feet waterward from the normal high
water line or the normal water level,whichever is applicable.
(b) Piers and docking facilities shall not extend beyond the established pier length along the same shoreline for similar
use. This restriction shall not apply to piers and docking:facilities 100 feet or less in length unless necessary to avoid
interference with navigation or other uses of the waters by the public such as blocking established navigation mutes or
interfering with access to adjoining properties as determined by the Division of Coastal.Management.The length of piers
and docking facilities shall be measured from the waterward edge of any wetlands that border the water body:
(c) Piers and docking facilities longer thaan 200 feet shall be permitted only if the proposed length gives access to deeper
water at a rate of at least one foot at each 100 foot increment-of pier length longer than-200 feet, or if the additional
length is necessary to span some obstruction to navigation..Measurements to determine pier and dockingfacility lengths
shall be made from the waterward edge of any coastal wetland vegetation that borders the water.body.
(d) Piers shall be no wider than six feet-and shall be elevated at least three feet:above any coastal wetland substrate as
measured from the bottom of the decking. : - .
(e) The total square footage of shaded impact for docks and mooring facilities(excluding the pier)allowed shall be•8
square feet per linear foot of shoreline with a maximum of 800-square:feet::In calculating the shaded impact,uncovered
open water slips shall not be counted iithe total.(f) The maximum size of any individual component of the docking facility authorized by this General Permit shall not
exceed 400 square feet.
(g) Docking facilities shall not be constructed in a designated Primary Nursery Area with.less than two feet of water at
normal low water level or normal water level under the general:permit set forth in this Section without prior approval
from the Division of Marine Fisheries or the Wildlife Resources Commission.
(h) Piers and docking facilities located over shellfish beds or submerged-aquatic-vegetation(as defined by the Marine
Fisheries Commission) may be constructed without prior consultation from=the-Division of Marine Fisheries or the
Wildlife Resources Commission if the following two conditions are met.
(1) Water depth at the docking facility-location is equal to or greater than two feet of water at normal low
water level or normal water level;and
(2) The pier and docking facility is located to minimize the area of submerged aquatic vegetation or
shellfish beds under the structure as determined by the Division of Coastal Management.
(i) Floating piers and floating docking facilities located in Primary.Nursery Areas, over shellfish beds, or over
submerged aquatic vegetation shall be allowed if the water'depth between the bottom of the proposed structure and the
substrate is at least 18 inches at normal low water level or normal water level.
(j) Docking facilities shall have no more than six feet of any-dimension extending over coastal wetlands and shall be
elevated at least three feet above any coastal wetland substrate as measured-from the bottom of the decking.
(k) The width requirements established.in Paragraph(d)of this Rule'shall not apply to pier structures in existence on or
before July 1, 2001 when structural modifications are needed:to prevent or minimize storm damage. In these cases,
pilings and cross bracing may be used-to provide structural support as long as they do.not extend more than of two feet
on either side of the principal structure; These modifications shall not be used to expand the floor decking of platforms
and piers.
(1) Boathouses shall not.exceed a combined total of 400 square feet and,shall have sides extending no further than one-
half the height of the walls as measured in a downward direction from the top wall plate or header and only covering the
top half of the walls. Measurements of square footage shall-be taken of the greatest exterior dimensions. Boathouses
shall not be allowed on lots with less than 75 linear feet of shoreline.
(m) The area enclosed by a boat lift shall not exceed 400 square feet.
(n) Piers and docking facilities shall be single story. They may be roofed butshall not allow second-storyuse.
(o) Pier and docking facility alignments along federally maintained channels shall also. meet Corps of Engineers
regulations for construction pursuant to Section 10 of the Rivers and Harbors Act of 1899(33 U.S.C.403).

(p) Piers and docking facilities shall in no case extend more than 1/4 the width of a natural water body,human-made
canal or basin. Measurements to determine widths of the water body,human-made canals,or basins shall be made from
the waterward edge of any coastal wetland vegetation which borders the water body. The 1/4 length limitation shall not
apply when the proposed pier and docking facility is located between longer structures within 200 feet of the applicant's
property. However,the proposed pier and docking facility shall not be longer than the pier head line established by the
adjacent piers and docking facilities nor longer than 1/3 the width of the water body.
(q) Piers and docking facilities shall not interfere with the access to any riparian property, and shall have a minimum
setback of 15 feet between any part of the pier and docking facility and the adjacent property lines extended into the
water at the points that they intersect the shoreline. The minimum setbacks provided in this Paragraph may be waived by
the written agreement of the adjacent riparian owner(s),or when two adjoining riparian owners are co-applicants.Should
the adjacent property be sold before construction of the pier commences,the applicant shall obtain a written agreement
with the new owner waiving the minimum setback and submit it to the Division of Coastal Management prior to
initiating any development of the pier or docking facility. The line of division of areas of riparian access shall be
established by drawing a line along the channel or deep water in front of the property,then drawing a line perpendicular
to the line of the channel so that it intersects with the shore at the point the upland property line meets the water's edge.
Application of this Rule may be aided by reference to the approved diagram in Paragraph(t)of this Rule illustrating the
rule as applied to various shoreline configurations. Copies of the diagram may be obtained from the Division of Coastal
Management website at http://www.nccoastalmanagement.net.When shoreline configuration is such that a perpendicular
alignment cannot be achieved,the pier or docking facility shall be aligned to meet the intent of this Rule to the maximum
extent practicable.
(r) Piers and docking facilities shall provide docking space for no more than two boats(a boat is defined in 15A_NCAC
07M.0602(a)as a vessel or watercraft of any size or type specifically designed to be self-propelled,whether by engine,
sail,oar, paddle or other means,which is used to travel from place to place by water)except when stored on a platform
that has already been accounted for within the shading impacts condition of this general permit. Boats stored on floating
or fixed platforms shall not count as docking spaces.
(s) Applicants for authorization to construct a pier or docking facility shall provide notice of the permit application to
the owner of any part of a shellfish franchise or lease over which the proposed pier or docking facility would extend.
The applicant shall allow the lease holder the opportunity to mark a navigation route from the pier to the edge of the
Iease.
