Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that I)prior to undertaking any activities authorized by this permit,the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available

as authorized by the State of North Carolina,Department of Environment,
Health,and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statues,"Coastal Area Management"
Issued to Mr. Ken Miller, authorizing the construction of a 1 38 lin. ft. retaining wall and approx. 200sq.ft.
sun deck, in the ORW shoreline AEC at 2535 Middle Sound Loop Rd, Wilmington, NC as requested in the
permittee's application dated August 1 , 2003. This permit, issued on April 25, 2003, is subject to
compliance with the application and site drawing (where consistent with the permit), all applicable
regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
• A copy of this permit shall be available onsite for regulatory inspection.
• An undisturbed buffer zone of a least thirty feet from the mean high water (normal water line)
must be maintained at all times.
• All proposed development and associated construction must be done in accordance with the
permitted workplat drawings as submitted and amended.
• All construction must conform to the N.C. Building Code requirements and all other local, State
and Federal regulations.
• Any change or changes in the plans for development, construction or land use activities will
require a re-evaluation and modification of this permit.
• The amount of built-upon area shall be limited to no more than 25% of the 575' Area of
Environmental Concern area of the land to be developed.
• No filling or development within any Federally regulated 404 wetlands is authorized.
• No sediment or building materials can be allowed to enter the marsh grasses or waters. Silt
fence or other protective barriers(s) must be placed and maintained between the disturbed
area and any 404 wetlands or coastal wetlands, to keep sediment from entering those areas.
