Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that I)prior to undertaking any activities authorized by this permit,the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief,certify that this project is consistent with the North Carolina Coastal Management Program.

This letter is to oppose the digging out of the canal that adjoins Lot 10 and 11 of Galleon
Bay. The digging out of this area on Lot 10 will cause debris to collect and cause a foul
odor. The adjacent end of this canal also does this.
Also,I have at my own expense had the canal dug out three times after storms have
caused it to fill in and replaced the bulkhead once at my own expense. No compensation
was paid by the previous owner of Lot 10 and when the new owner purchased Lot 9 and
10 he was made aware of the problems that existed with this canal.
If the previous owner insist on digging out the canal and he is permitted to do so he will
be responsible for also replacing fifty(50) foot of bulkhead on Lot 11 which is owned by
myself.
Also I will not agree to the 15' setback requirement due to the fact that the ordinance of
Galleon Bay and North Topsail Beach required. I feel others have obeyed this ordinance
and it should be done now as well.

This letter is in response to your June 12, 2003, correspondence regarding your concerns about the
proposal by Mr. Brad Koury's plans to build a bulkhead,boat basin, boat ramp and dock on his lot, adjacent to
your property, at Lot 11 at Galleon Bay, in North Topsail Beach, in Pender County. The proposed project has
been determined to comply with the Rules of the Coastal Resources Commission (7H.1200, 7H 1100, 7H 1500,
and 7H 1300) and as such, the Division has issued a CAMA General Permit for the proposed actions. I have
enclosed a copy of the rules which govern the issuance of permits for docks, bulkheads, boat basins and boat
ramps.
If you wish to contest our decision to issue this permit, you must file for a contested case hearing within
twenty(20) days from the date the permit was issued (9/9/03). I have enclosed the applicable forms and
instructions that must be filed prior to that deadline. Please contact me at (910) 395-3900, if you have any
