Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that I)prior to undertaking any activities authorized by this permit,the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief,certify that this project is consistent with the North Carolina Coastal Management Program.

Please find enclosed two riparian property owner notification/waiver forms for the land
owned by the town on either side of the entrance to the Heritage Harbor Subdivision. In
order for the HHPOA to obtain a general CAMA maintenance permit, we need you to
' sign these waivers. Also included is a diagram indicating the site removal area and cubic
• yards to be removed. This material will be transported by barge to the mainland where it
will be trucked to a CAMA approved dumpsite.

Dear Mr. Varnam,
The HHPOA is in the process of obtaining a general CAMA maintenance permit to
remove approximately one thousand cubic yards (1000 cu yds) of silt from the entrance
of our canals at the Intracoastal Waterway. This work will be performed by a local
dredging contractor. I understand that a dragline crane mounted on a barge can scoop the
material out and place it on the same barge. The barge will then carry the material back
to the mainland where it will be trucked to a CAMA approved dumpsite.
Included is a diagram of the proposed area to be dredged. The canals and entrance were
dredged during the '96-'97 winter dredging season. The entrance has since then
developed a slight hump about half way inside the canal entrance. This shallow spot(.9
to 1.8 feet depending on tide)has not only become a navigation problem but is impeding
the natural flow of the tides.
I understand per our conversation this morning that the Corps will not require anything
from HHPOA since the small amount of dredge material will be hauled offsite to the
mainland. I appreciate all the information you gave me. I look forward to maybe
working with you and Mr. Frabotta in a couple of years when we dredge all the canals.
