Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that I)prior to undertaking any activities authorized by this permit,the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief,certify that this project is consistent with the North Carolina Coastal Management Program.

Dear Mr. Fox:
The Division of Coastal Management is in receipt of the CAMA Major Permit
Application submitted for Mr. Fred Davis to construct a dock at his property on Ocean Isle
Beach, Brunswick County, NC. During our preliminary review, it was determined that Mr.
Davis' proposal can be authorized under our General Permit for construction of piers and docks
(T15A NCAC 7H .1200, copy attached). A CAMA Major Permit is not necessary for this
project. Therefore, we are returning your check (# 4234) to DENR in the amount of$250.00 for
the Major Permit Application Fee.
If your client wishes to proceed with obtaining a General Permit for the proposed dock,
the fee is $100.00. We can utilize the adjacent property forms and drawing submitted with the
Major application.. A permit could then be issued in one of two ways. One is to meet at the
property with Mr. Davis or with you, as the applicant's agent, and issue the permit when the site
visit is made. A second way would be for you to mail us the check, and we can send the permit
to Mr. Davis after the site visit is made. Then, a signed copy would need to be returned to our
office for the files.

Dear Mr. David:
The Wilmington Regional Office received a copy of your application for the project
known as Fred David Dock. Staff of the Wilmington Regional Office have reviewed the
application for the applicability of the Stormwater Management rules to the proposed activity at
this project. Based on our review, you do not appear to be proposing a development activity on
this site at this point in time that would be subject to the stormwater requirements as provided for
in 15A NCAC 2H.1000. Please be advised that other regulations will potentially apply to your
proposed activities.
If your project disturbs one acre or more and has a point source discharge of stormwater
runoff, then it is subject to the National Pollutant Discharge Elimination System (NPDES)
stormwater discharge requirements. You are required to have an NPDES permit for stormwater
discharge from projects meeting these criteria.
This exemption applies only to the Coastal Stormwater Management Permit for the
currently proposed activity. If at any time in the future, development of any part of this site is
planned, as defined in NCAC 2H.1000, or if the proposed activities differ in any manner from
what is shown on the plans on file with the Division, you must submit the project for review of
the applicability of the stormwater management rules. If you have any questions concerning this
matter, please do not hesitate to call me at (910) 395-3900.

filled out and submitted. We are basically applying for a second dock on the property

8:45 AM Public Hearing: A public hearing will be held to consider the following:
a. A request to rezone a portion of property located at 6875 Beach Drive,Ocean
Isle Beach. This entire tract contains 4.53 acres and the front portion
containing approximately 2.24 acres is presently zoned C-3. The property --- ,--

This property is bouaded`oY►the North-Side by NC Hwy::179-904(Beach---�—_
Drive) on the East Side by Tarheeland Acres Subdivision,on the south side by
East Magnolia Street and on the West Side by Ocean Haven Subdivision. A
copy of the map indicating the proposed zoning change is on file for review at
the office of the Planning/Zoning Department between the hours of 8:00 am to
4:30 pm,Monday through Friday.
b. A modification to Section 66-281(m) of the zoning ordinance as same pertains
to floating docks and boat lifts that would add a sentence to the text that
reads"All residential lots bordering the finger canals with fifty foot of width
shall be limited to one fixed or floating dock and one lift for waterborne
recreational vehicles. Lots of 55 foot of width and larger shall be limited to
two docks and two lifts for waterborne recreational vehicles. The
northernmost lots bordering the Intracoastal Waterway and connecting to
canals number 14, 17, 19 and 21 and$A and 8B are allowed to use the water
frontage on both side of the lot for docks and lifts. Launching and retrieval
devices for personal watercraft less than 15 feet length are allowed when
mounted on the dock and the personal watercraft does not protrude into the
canal space." Additionally, the set backs for docks from side property lines
would be changed from fifteen fe to ten feet_and would pertain to botk
docks and bo t lifts. Following the public hearing,these matters will be
addressed by the oard in Open session. The Board may adopt proposed
changes to the ordinance a:I set out, and may make modifications to the
proposals following input received in public comment.
