Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that I)prior to undertaking any activities authorized by this permit,the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s). I did see the damage on the end of the floating dock but we can't replace the whole facility under the .2500 (emergency hurricane) permit. There are a few options for permits depending on what the applicant wants to repair/replace: 1. I can write general permit .2000 to replace/repair the whole facility as needed in the same footprint. For this I would need an Agent authorization,waivers from BOTH adjacent riparian property owners, and a $200 check. 2. I can write a .2500 (hurricane permit) for replacing only the 6'x30' floating dock. It looks like the gazebo is very close to the 15' setback and the lift is in the setback—hence the need for waivers from both sides. If the applicant doesn't want to do work on the gazebo or the boatlift we can proceed without waivers but the adjacent property owners will still need to be notified.
