Based on the revised drawing provided by the applicant, the proposed pier and dock will not extend into the 15 foot riparian corridor setback. The proposed project has been determined to comply with the Rules of the Coastal Resources Commission (7H.1200), and as such, the Division has issued a CAMA General Permit for the proposed action. I came in to voice my concerns and objections concerning the letter I received via certified mail from Mr. John Costa on Monday,November 17th. He sent me a two-page packet,which was his attempt to inform me of his intent to build a pier on his property,which is adjacent to my property. I will list the problems and inaccuracies of this communication. 1)Mr.Costa was directed by Donna Moffitt,Director,Division of Coastal Management,North Carolina Department of Environment and Natural Resources,to resubmit a drawing,which showed his proposed pier and dock having setbacks based on the riparian corridor established in 1999 by CAMA. He was told by Ms. Moffitt to send this revised drawing to his adjacent property owners.Mr.Costa did not revise his drawing as requested but just sent out the same sketch he had used earlier in a prior adjacent notification. In our discussions yesterday morning,we agreed that his drawing was inadequate and did not show the necessary changes that Ms. Moffitt directed. 2)Mr.Costa placed some descriptions on the header of his resubmitted proposal that is not acceptable.He states that his proposed pier and walkway is 372 feet in length. We agreed that using the term"walkway" is wrong.The entire structure he is proposing is a pier.The entire length of structure he proposes will be set over land that has been designated by CAMA to be below the marsh line and also his property is designated on county maps as a salt marsh.Any structure built on his property will have to be elevated and conform to the general statutes,which CAMA regulates in order to protect wetlands.You specifically informed me that if a CAMA permit is issued that the term"walkway"is not allowable since the whole structure must be referred to as a pier. Also,we discussed my conversation with the Assistant Director,Mr.Charlie Jones. Mr.Jones stated that Mr.Costa's proposed structure,due to its elevation and terrain crossed,is a pier in its entirety. 3)You acknowledged that Mr.Costa needs to provide this drawing with more details and accuracy to show dimensions and setbacks. I find it disturbing that Mr.Costa sent out his second proposal without it having been reviewed by either you or Mr. Dail,especially due to the directive given to Mr.Costa in a letter by Ms. Moffitt dated November 03,2003. I feel strongly that Mr.Costa should submit a corrected drawing as directed by Ms. Moffitt.Then he could send that approved drawing to his adjacent property owners for review. Since the permit has already been issued to Mr. Costa,this seems to be a futile correspondence. Let it be noted that we received this adjacent riparian property owner notification on March 5, 2004,but the permit had been issued on February 24, 2004. We should have received Mr. Costa's preliminary work plat drawing of his proposal with this notification;instead, we received a copy of Mr. Dail's-drawing from the permit after it . had already been issued. We have objected twice before to applications by Mr. Costa for proposals to build on this property and our concerns have never changed the decision to issue a permit. You may contact Mr. Charles Jones for details of our objections, since we had to submit them to him in our request fora third party hearing on this"new"permit. We felt a response was necessary because your letter seemed to represent a completely different position than that given to us when we spoke to you in person on February 24, 2004. As you are aware, at that meeting we told you Mr. Costa had not informed us of his intent to build a pier and dock on his property and we were completely shocked that he had been granted a"new" permit. We were also completely unaware that he had rescinded permit #35156-D until we spoke with you that day by telephone. As proof to CAMA of notification, he had indeed submitted a"green card"; however, to reiterate, this card was obtained only because of a letter Mr. Costa sent to us offering his properties for sale. We were able to show you this letter, as well as our response letter with matching certification numbers to document what had transpired. Again, this correspondence was not an attempt to inform us of his intent to build a pier and dock. When you examined these letters along with their envelopes and matching certified-date-stamps, you were satisfied by the evidence. You spoke with Mr. Gregson on the phone, in my presence, over this apparent breach of protocol and collectively your office decided to suspend Mr. Costa's "new" permit until he properly notified us as required by regulation. In a letter dated February 25, 2004, Mr. Gregson informed Mr. Costa that his"new" permit would remain in suspension until we were given proper notice. On March 3, 2004, we received a letter from you dated February 24, 2004. This letter informed us that we had 20 days from the date Mr. Costa's"new" permit was written to complete our request for a third party hearing, giving us only a few days to file our second request for a third party appeal. We strongly disagreed with this time line because it was inconsistent with what we had previously been told regarding suspended permits and request for appeal; yet, you would not consider our objections and held firm to this deadline, Later, on March 5, 2004, we received a telephone call from Mr. Gregson confirming that our position regarding the deadline was indeed correct; however, by that time our second request for a third party hearing had already been submitted to Mr. Jones and the Attorney General's Office. On March 5, 2004, we received a letter from Mr. Costa's attorney (dated March 2, 2004) with an attached copy of the"new" permit drawing rendered by CAMA, rather than an actual work plat of Mr. Costa's intention. Only today, March 17, 2004, did we receive for the first time a work plat enclosed in your letter to us dated March 9, 2004, notifying us of Mr. Costa's intentions to build a pier and dock on the property.
