Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that I)prior to undertaking any activities authorized by this permit,the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available

Reference your application dated August 6, 2003, requesting Department of the Army
(DA) authorization to construct a pier/dock facility approximately 3 miles south of Supply, on
the Lockwood Folly River, 53 Plantation Passage Drive, SE, Lot V2, Winding River Plantation
Subdivision, Brunswick County, North Carolina.
On July 2, 2000, we renewed general permit No. 197800056, (copy enclosed), that
authorizes the maintenance, repair, construction and installation of piers, docks,boathouses and
boat shelters, mooring piles, dolphins,jetties and breakwater structures in navigable waters of the •
United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act
of 1899.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general conditions, and the following special conditions:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. .
2. An as built survey of the structure will be sent to our office for review for navigation
concerns.
Your proposed work is authorized if you can comply with all permit conditions. Please
read the enclosed permit to prevent an unintentional violation of Federal law. As this
Department of the Army regional general permit does not relieve you of the responsibility to
obtain any other required approvals, you should contact appropriate State and local agencies
before beginning work.

General Statues,"Coastal Area Management"
Issued to Jim Abernathy, authorizing development in Estuarine Shoreline at 53 Plantation Passage Drive SE,
Lot V-2, Winding River Plantation, Bolivia NC 28422 requested in the permittee's application, dated
15-Aug-03. •This permit, issued on 04-Sep-03, is subject to compliance with the application and site
drawing (where consistent with the permit), all applicable regulations and special conditions and notes set
forth below. Any violation-of these terms may subject permittee to a fine, imprisonment or civil action, or
may cause the permit to be null and void. •
This permit authorizes
(1) A silt fence or natural buffer must be positioned between any land disturbance and adjacent waters or
wetlands. In no case, shall erosion of disturbed areas result in deposition of this material into adjacent
waters or wetlands.
(2) All proposed development and associated construction must be done in accordance with the permitted
work plat drawings(s) [10'x 16' deck along landward edge] submitted on 15-Aug-03.
(3) All construction must conform to the N.C. Building Code requirements and all other local, State and
Federal regulations, applicable local ordinances and FEMA Flood Regulations.
(4) Any change or changes in the plans for development, construction, or land use activities will require a
re-evaluation and modification of this permit.

(5) All development projects, proposals, and designs shall limit the construction of
impervious surfaces and areas not allowing natural drainage to only so much as
is necessary to adequately service the major purpose or use for which the lot is to be
developed. Impervious surface areas shall not exceed 30% of the lot area within the
75 feet Area of Environmental Concern. However, no construction of a single-family
dwelling shall occur within 30 feet of normal water level.
(6) No impermeable surfaces shall be allowed over any functional part of the septic tank
system.
(7) All unconsolidated material resulting from associated grading and landscaping shall be
retained on site by effective sedimentation and erosion control measures.
(8) All disturbed areas shall be vegetatively planted and mulched within fourteen days
of construction completion.
(9) The first floor elevation must be in compliance with Federal Flood Insurance Rate
Map Elevations.
(10) Pursuant to 15 NCAC, Subchapter 7J.0406(b), this permit may not be assigned,
transferred, sold or otherwise disposed of to a third-party unless done so by the
Director of the Division of Coastal Management.
(11) .A building permit and zoning compliance must be obtained prior to any construction.
