This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that I)prior to undertaking any activities authorized by this permit,the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief,certify that this project is consistent with the North Carolina Coastal Management Program.

Dear Jason,
First of all thank you for all your help with
answering our questions concerning this project.
You have been patient, and understanding more than
even called for; something rarely seen in these days.
This is a reply to the most recent request for a
general permit for proposed work to be done at the
the property owned by Tim Ward 1512 Burnett Rd.
We have many reasons to wish for a denial of a permit.
to perform any work on the bulkhead walls . There is
an on going property dispute, as to whether Tim Ward' s
existing bulkheads are on his actual property.
I have personaly checked our side; being the southern
side adjoining his property, and found the existing
bulkhead to be as much as three feet over the line.
I have spoken to some of the home owners, and they are
sure that this problem exists on the north side as well.
This is the side he proposes to replace, and it seems
that he wants to move even as much as two more feet
farther out. This is not acceptable. Whether it is deeded
land or a right of way; you can not just take claim of it
to be your own. This seems to be a family trait, because
his father Homer Ward also took claim to a large amount
of property that belongs to the state in the Inland
Waterway. If allowed to replace his bulkhead it should
not be allowed to go any further into the waterway than
it now is .
We have the inlet directly across from our property,
and due to this; there is a lot of erosion. We are certain
to have erosion problems if this bulkhead is allowed to be
moved from it ' s existing position, or to change the angle
of it. This would ruin our sandy beach we enjoy for
recreation, and would certainly alter a channel that flows
close to our property. This channel flows about midway
of his pier paralell to the shore aproximately half way
out under our pier. It has been this way for many years,
and the fish come through it in great numbers . It would

certainly change the flow of this channel to alter his
existing bulkhead as from the way it now exists . We have
on the southern side of our property a channel that comes
in to our seawall from the waterway. This channel is the
natural habitat for many species of marine wild life.
Minnows live there by the thousands . The saltwater birds,
and many species of fish will certainly loose a great
resource for nourishment and growth if his bulkhead
causes this channel to close. This channel is only
about sixty feet from his southern property line.
There is also thousands of clams, and muscle clams
living directly behind Tims property.
It is for these reasons that we have to say no to any
change in his bulkhead walls . I love to see the wildlife
living there in harmony with what now exists. To alter
the walls on his bulkhead will surely cause unrepairable
damage to their habitat.

Dear Sir or Madam:
I received Tim Ward's Division of Coastal Management Adjacent Riparian Property Owner
Notification/Waiver Form from Tim Ward via hand-delivery on November 28, 2004. Mr. Ward
explained to me that the Property Survey With Proposed Structures dated February 19, 2004, was
in fact not what he was planning to do,but instead he planned to alter the Survey. As such,I would
appreciate a revised Survey as to exactly how Mr. Ward wishes to replace his bulkhead.
If Mr.Ward wishes to repair his bulkhead as is shown on the Survey,then I have no objection
to same so long as the appearance of the bulkhead is not altered,the new bulkhead is in conformity
with the same materials as was previously used and the bulkhead does not encroach onto the
properties adjacent to 1512 Burnett Road. This includes Lot 8 adjacent to Mr. Ward's property on
the north.
Since the attached Survey does not contain plans for a "pier, dock, mooring pilings,
breakwater,boat house or lift",I understand that a setback waiver does not apply;however,if same
is deemed appropriate, I do not wish to waive the 15' setback requirement.

for an administrative hearing to challenge CAMA General Permit GPD36899. The Third Party Hearing
Request was filed on behalf of petitioner Ms. Violet Ward on December 20, 2004. Under N.C.G.S.
§113A-121.1 (the Coastal Area Management Act), your CAMA permit is automatically suspended upon
receipt of a hearing request and will remain suspended until either: (1) Chairman Tomlinson denies the
hearing request (under standards set out in the statute); or(2) there is a final Coastal Resources
Commission decision on the permit appeal. You may not undertake any development under the permit
until further notice after Chairman Tomlinson issues his decision.
The Division of Coastal Management will prepare a recommendation for the Chairman on

Dear Mr.Ward:
The Chairman of the Coastal Resources Commission,Eugene Tomlinson,has received a request
for an administrative hearing to challenge CAMA General Permit GP038899. The Third Party Hearing
Request was tiled on behalf of petitioner Ms.Violet Ward on December 20,2004. Under N.C.G,S.
§113A-121.1(the Coastal Area Management Act),your CAMA permit is automatically suspended upon
receipt of a hearing request and will remain suspended until either: (1)Chairman Tomlinson denies the
hearing request(under standards set out In the statute);or(2)there is a final Coastal Resources
Commission decision on the permit appeal.You may not undertake any development under the permit
until further notice after Chairman Tomlinson issues his decision,
The Division of Coastal Management will prepare a recommendation for the Chairman on
whether to grant or deny the hearing request.The Chairman must make a decision within 15 days after

As a past resident of Burnett Road, I wanted to advise you of a recent oversight by
CAMA. It is my understanding that Mr. Tim Ward of 1512 Burnett Road recently
applied for a permit to repair his bulkhead and widen his boat ramp. As required by law
you notified the adjacent property about this request. There is property between Mr.
Altman and Mr. Ward's property, which is owed by the Tucker-Burnett Subdivision
property owner since 1947. The county does not tax this property, but it is the deeded
water access for this community and has been for fifty-six years. I will try to fax a copy
of the deed but if you find it unreadable please refer to Book 409, Page 274.
As I am sure you are aware there has been a battle between the residents and Mr. Ward
about the validity of 1971 special use permit. Mr. Ward would like to put a large
commercial marine on his property. Mr. Homer Ward did not do the required
maintenance dredging to this property and I would like to refer you to your rules
concerning dredging-
15 ANCAC 07H.0208 USE STANDARDS
(b) Specific Use Standards
(1)Navigation channels, canals, and boat basins shall be aligned or located so as to avoid
primary nursery areas highly productive shellfish beads, beds of submerged aquatic
vegetation, or significant areas of regularly or irregularly flooded coastal wetlands.
(J) Maintenance excavation in canals, channels and boat basins within primary nursery
areas and beds of submerged aquatic vegetation shall be avoided
(ii) There shall be clear evidence that the channel was continuously used for a specific
purpose
(B) Marinas which require dredging shall not be located in primary nursery areas not in
areas which require dredging through primary nursery areas for access. Maintenance
dredging in primary nursery areas for existing marinas shall be considered on a case-by-
case basis under the standards set out in Part(b)(1)(J) of this Rule.
Since allowing unnecessary repairs and unneeded expansion would only encourage Mr.
Ward's attempts to destroy this primary nursery areas and it's adjoining community
access I would like to encourage you deny any new permits and request.

Dear Jason:
On behalf of Carolina Marina, LLC, I am requesting CAMA General permits(GP 0.1300
and GP 0.1100) to allow for replacement of a ramp and bulkheading on the above-
referenced property. Approximately 448 linear feet of bulkhead would be installed to
replace existing, failing bulkhead along the northern half of the shoreline. The alignment
of the proposed bulkhead would largely mimic the current alignment. A ramp also exists
on the property, and the applicant requests to replace this ramp with a 15'-wide ramp.
The new ramp would be located in roughly the same location, but aligned more
perpendicular to the shoreline. No coastal marsh exists waterward of the proposed
bulkhead or within the area of the proposed ramp. The adjacent landowner notifications
have been mailed and proof of receipt is enclosed. If you have any questions during your
