Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action;and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that I)prior to undertaking any activities authorized by this permit,the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s)
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief,certify that this project is consistent with the North Carolina Coastal Management Program.

RE: 3718 E Dolphin DR/CAMA application
I talked with Jim Gregson today concerning Mr. Porter's proposed project at 3718 E. Dolphin Drive.
Jim Gregson stated that Mr. Porter does not qualify for either buffer regulation exemptions, 15A
NCAC 07H .0209 (10), (I) or(J). If Mr. Porter chooses not to reduce the footprint of his house to
comply with the regulations and wishes to build within the buffer, he will have to appeal and
request for a variance from the buffer regulation. Mr. Gregson also stated that if Mr. Porter's deed
states he owns to the normal high water mark, than he will gain the additional land created by the
bulkhead. However, if his deed states he owns by the existing monuments and not to the normal
high water mark, then he will have to adjust his town setback of 20'form the rear property line and
not the bulkhead. I relayed this information to Jim Boney and he is going to research Mr. Porter's
deed to see what Mr. Porter actually owns. Mr. Boney did suggest that if Mr. Porter does not own
to mean high tide that he quit claim the property. This would allow him to use the bulkhead for
compliance with town setbacks.
I informed Mr. Porter of this decision and that I would assist him as much as possible for filing the
appeal. Mr. Porter was unclear as to what avenue he will pursue at this time. I tried to encourage
Mr. Porter to file for an appeal and request a variance, stating to him that due to the irregular shape
and size of his lot that there was a good possibility for a variance to be granted. I told Mr. Porter
that I would try and have an appeals packet ready for him tomorrow. Hopefully I'll be hearing from
him and get the appeals procedures started.
I'll keep all inform of any updates.
