Based on the survey conducted by Mr.Adams' surveyor,the sealed elevation certificate from his property, and review and input from the NC Geodetic Survey, we have determined that there are no apparent uplands(land above Mean High Water) in the area where Mr. Adams is proposing a fixed platform. The survey confirms staff observations on site that Mr.Adams' property is riparian where the mean high water line touches the bounds of his property. I have attached the survey and elevation certificate. Based on these, DCM believes there is no land above MHW in the area of the proposed pier and there are no submerged lands claims in the area of the proposed pier as well. For the land area within your parcel boundaries,you would own all areas that are above MHW. The Division of Coastal Management has not yet issued the permit for the development of the fixed pier but will do so soon. When I do, I will simultaneously send you a letter that contains the instructions and a simple form for filing a 3rd party appeal of the permit decision, if you should choose to do so. With no such upland, there are no riparian area conflicts that would impact Mr. Adam's proposed pier/platform.Also explain that Mr.Adams parcel touches MHW so that portion of his property is riparian,and can be allowed to get a pier permit. Are there any outstanding issues with his platform design? Has he done notice yet? Make sure Ms. Flower is included as an Adjacent Riparian Owner too. Once we have notified Ms. Fowler and are ok with his platform orientation and design, then I don't see a problem issuing a permit based on property ownership issues. The project consists of constructing a fixed access pier and upland deck, adjacent to the subject property. Based on consistency with the Rule requirements outlined in 15A NCAC 07H .1200, GENERAL PERMIT FOR CONSTRUCTION OF PIERS AND DOCKING FACILITIES: IN ESTUARINE AND PUBLIC TRUST WATERS AND OCEAN HAZARD AREAS, , a permit has been issued to authorize the development. I have enclosed a copy of the permit, as well as the relevant statutes. If you wish to contest our decision to issue this permit, you may file a request for a Third-Party Appeal. The Chairman of the Coastal Resources Commission will consider each case and determine whether to grant your request to file for a Contested Case Hearing.
