bags may remain in place for up to 4' years after the date of permit
approval. I understand that I will be responsible for removing the
sandbags within 30 days after that date or at any time that they are
determined by DCM staff or its agent to be unnecessary due to
relocation or removal of the structure. I will also be responsible for
removing any damaged sandbags during the period they are authorized
to be in place.
I also understand that the removal of the sandbags shall not be
required if at the specified date for removal they are determined by
DCM staff to be covered by dunes with vegetation sufficient to be
considered stable and natural.

SPECIAL CONDITIONS
1. 1. Prior to any construction, all derelict coastal armoring geotextile material and other debris must be
removed from the beach to the maximum extent possible.
2. During construction, trash and food items shall be disposed of properly either in predator-proof
receptacles, or in receptacles that are emptied each night to minimize the potential for attracting
predators of piping plovers, red knots, and sea turtles.
3. In the event the structure begins to disintegrate, all debris and structural material must be removed
and deposited off-site immediately upon coordination with the Service. If removal of the structure is
required during the period from May 1 to November 15, no work will be initiated without prior
coordination with the Corps and the Service.
4. All personnel involved in the construction activity shall be aware of the potential presence of piping
plovers and red knots. Before start of work each morning, a visual survey must be conducted in the
area of work for that day, to determine if piping plovers and red knots are present. If shorebirds are
present in the work area, careful movement of equipment in the early morning hours should allow
those individuals to move out of the area. Construction operations shall be carried out at all times in a
manner as to avoid antagonizing shorebirds while allowing them to exit the area.
5. Any work should only take place during daytime hours, after sea turtle volunteers have finished all
morning patrols and marked any nests for avoidance. Work should not be conducted within 50 feet
(on any side) of a sea turtle nest marker.
6. If a new sea turtle nest is laid after the date of permit issuance and before work is conducted, please
contact the Service and NCWRC for further consultation.
7. Vehicles should access the beach as close to the work area as possible, to limit travel down the beach.
8. Vehicles should travel on wet sand, to the extent possible.
9. If any nests are uncovered, then all work must stop. Notification should immediately be made to
NCWRC's sea turtle hotline (252-241-7367), as well as the local sea turtle volunteer coordinator and
the USFWS (919-856-452, ext. 20). Work should not resume until after the sea turtle volunteers are
able to manage the nest and eggs. Compliance with the measures outlined here do not provide any
regulatory relief, if a nest is damaged or destroyed.
It is not necessary to submit an RFA form to the Division Office if you do not object to the determination in this
correspondence.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with your submitted
application, drawings and the attached Special Conditions.Any violation of the attached conditions or deviation from your
submitted plans may subject the permittee to a stop work order,a restoration order,a Class I administrative penalty,and/or
appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide and/or regional general permit
authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide and/or regional
general permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below,
provided it complies with all requirements of the modified nationwide permit. If the nationwide and/or regional general permit
authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and
conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to
commence in reliance upon the nationwide and/or regional general permit,will remain authorized provided the activity is completed
within twelve months of the date of the nationwide and/or regional general permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above)may also require an individual Section 401 Water Quality Certification. You
should contact the NC Division of Water Resources(telephone 919-807-6300)to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (CAMA),
prior to beginning work you must contact the N.C.Division of Coastal Management in Wilmington,NC,at(910)796-7215.
This Department of the Army verification does not relieve the permittee of the responsibility to obtain any other required Federal,
State or local approvals/permits.
