Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action;and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that I)prior to undertaking any activities authorized by this permit,the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief,certify that this project is consistent with the North Carolina Coastal Management Program.

My name is Gary Hurley, and I am the property owner at 6601 Sylvan Lane,Wilmington, NC 28403. Our friends (the
Abneys)that live on Falcon Pointe just made us aware of a proposed pier being built out into the small creek that sits
between Falcon Pointe and Sylvan Lane (I think it is called Swash Creek?).
The proposed pier would be applied for (has been applied for?) by the new neighbors of the Abneys, whom I believe are
the Millers and reside at 6708 Falcon Pointe.
If their pier is allowed to be built out 70' (as was identified to us via a drawing), we believe that would be cumbersome
to the creek, a very very low water creek that would allow for no boat access. The proposed pier would also be obtrusive
to everyone's privacy on both sides of that little creek, and if they decided to put lights on such a long dock,then the
lighting itself would disrupt the peace and quiet of our community.
We are also very concerned because the drawing that was shared with us didn't show our side of the creek,the Sylvan
Lane side, so that we could better gauge just how far out a 70' dock gets them to the center of the creek.
We object to the 6708 dock proposal and wish to know what other measures we could take to help block the building of
the proposed pier.

Hi Katherine. Thank you in advance for your time.
I am writing to begin the process of objecting a CAMA permit for a dock at 6708 Falcon Pointe Rd.
The proposed dock is a 70 foot pier that invades the natural preserve of Barren Inlet Creek and Howe Creek. We believe
the purpose of the pier is to gain optimal view of the waterway, however it would be settled right into oyster beds and
serve no purpose for boating. This is basically an extended living room for the residents. Such pier will invade the
privacy of homes along Barren Inlet Creek and restrict access to their humble day docks. There are 6 -7 homes that this
would greatly impact. Not to mention the enormous amount of wildlife living among this area.
Another reason for my objection is that we can't understand the need to build a 70 foot pier, right alongside our
property line and facing the direction of our backyard. The placement of the dock is directly at our 15 feet setback and,
by way of the creek, crosses diagonally to face our property.
I have spoken with the neighbor on the other side and I'm sure you'll be hearing from him as well.
Please let me know what needs to be done and what, if any, power we have to stop this permit from being accepted.
