violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .

MOORING SPACE RENTAL CONTRACT
THIS MOORING SPACE RENTAL CONTRACT is entered into this I day of r'1 2020 between
Sea Gate Association, Inc., and the Property Owner named below.
Purpose:
To provide a homeowner whose property boarders the marina, the exclusive use of a mooring space in the marina basin
behind their property. The mooring space will be within an area ten feet inside the extended lines of their property, not to
exceed %uja" rV Fiut (rs) feet from the bulkhead (reference attached drawings). Sea Gate Association, Inc. is
offering this contract as a means to reimburse the property owner for paying the cost to replace the entire section of
bulkhead behind their property with a new vinyl bulkhead. The bulkhead construction must be approved by the Sea Gate
Association Board of Directors (including Contractor Selection, Permits, Plans, and Drawings).

Contract Start & Duration:
This contract will start when full payment is guaranteed by the homeowner (signed contract between the property owner
and the contractor) and construction is started. The contract duration will be for a period of forty (40) years, or the end of
life of the bulkhead (replacement of the bulkhead), whichever is greater. This contract will extend to subsequent owners
of the described property during the duration of the contract and must be included in any future property sale or transfer
contract.
Terms and Conditions:
The bulkhead and any construction in the marina basin or on Sea Gate Association property is the property of Sea Gate
Association, Inc.
No permanent structures may be built on Sea Gate Association property between the bulkhead and the homeowner's
property without written approval from the Sea Gate Board of Directors. The homeowner is hereby permitted to run
utilities (water, electricity) to the bulkhead from their property.
The homeowner will have exclusive use of the mooring space to moor their personal watercraft for a fee of $1.00 per,yrVr
for the duration of the contract; limit of two watercraft at any one time. The mooring space is for the exclusive use of'th6
homeowner's personal watercraft and cannot be used for any other purpose, with one exception being; homeowner guests -
can moor their boat within the mooring space for a period not to exceed forty-eight (48) hobrs. Subleasing is not
a
permitted.

Watercraft and/or moorings (including pilings and anchors) cannot extend outside of the defined mooring space.
The property owner has the right to repair the new vinyl bulkhead and maintain it in its orighial condition.
The Sea Gate marina property, including the mooring space defined in this contract is currently not,zoned for boattifts. if
in the future such zoning is changed to allow boatlifts, the property owner may install a boatlift at his/her expense within
the above referenced mooring space, subject to approval by the Sea Gate Board of Directors (includes Contractor
Selection, Permits, Plans, and Drawings), such approval not to be on rg py tly viit�ield.

The property owner agrees to be bound by the current Sea Gate Association, Inc. Policies and Procedures Book
adopted by the Sea Gate Association, Inc. Board of Directors which is available through the Marina Office or at the Sea
Gate Association, Inc. Web Site. This includes having the proper forms completed and on file in the Marina Office. Said
policies and procedures may be lawfully changed from time to time by the Sea Gate Association Board of Directors. It
shall be the responsibility of the property owner to abide by these policies and procedures, and to keep apprised of the
most current permutation of such policies and procedures. In any explicit conflict between the policies and procedures and
this contract, this contract shall govern.
The property owner agrees to be bound by the current Sea Gate Marina Rate Table as lawfully established from time to
time by the Sea Gate Association Board of Directors. The Sea Gate Marina Rate Table "Non -Package" rates will apply to
the property owner unless the property owner purchases a "Marina Package". From time to time the Sea Gate Association
Board of Directors may extend specific discounts or privileges, for limited periods, to persons renting a slip which shall
also apply to the property owner. In any explicit conflict between the Sea Gate Marina Rate Table and this contract, this
contract shall govern.
Sea Gate Association, Inc. cannot and will not be responsible for the property owner's loss of any kind related to the
mooring space, regardless of the cause, including wind storms, theft, pilferage, fire, water damage, hail, vandalism,
freezing, heat loss, or Acts of God. To the fullest extent permitted by law, the property owner releases Sea Gate
Association, Inc. and its staff from any and all liability.
At the end of the contract, Sea Gate Association will send notice to the property owner stating that the contract period is
over, and that the property owner will continue to have exclusive use of the mooring space at the small slip rate (small slip
without water and electricity). If the property owner has installed a boatlift (conditional zoning has changed to allow
boatlifts), the small slip rate will apply to the mooring space with the boatlift included in the rate. The rate will be on a per
month basis, only for the months or portions of a month that a watercraft is in the mooring space.
Property Owner acknowledges that he/she has read, understood, and agreed to comply with this Contract and the Sea Gate
Association, Inc. Marina Regulations.
